Article 38 of the Seed Law of People's Republic of China (PRC) stipulates as follows:
The effective area of the seed production and operation license shall be determined by the issuing authority within its jurisdiction. Seed producers and operators who set up branches in the effective area specified in the seed production and operation license to specialize in packaged seeds that are no longer repackaged, or who are entrusted in writing by seed producers and operators with seed production and operation licenses to produce and sell their seeds, do not need to apply for a seed production and operation license, and shall file with the local agricultural and forestry authorities.
Seed enterprises that combine breeding, production and management and meet the requirements set by the competent departments of agriculture and forestry in the State Council, the effective area of their production and operation licenses is the whole country.

Forty-first seeds sold shall meet the national or industrial standards, with labels and instructions for use. The contents marked on the label and instruction manual shall be consistent with the seeds sold. Seed producers and operators shall be responsible for the authenticity of the marked contents and the quality of seeds.
The label shall indicate the seed category, variety name, variety approval or registration number, variety suitable planting area and season, production operator and registration place, quality index, quarantine certificate number, seed production and operation license number and information code, and other matters stipulated by the competent department of agriculture and forestry of the State Council.
Seed sales of authorized varieties shall be marked with the variety right number.
The sales of imported seeds shall be accompanied by the import approval number and Chinese label.
When selling the seeds of genetically modified plant varieties, obvious words must be marked, and safety control measures should be suggested when using them.
Seed producers and operators shall abide by the provisions of relevant laws and regulations, be honest and trustworthy, and provide seed users with information on seed producers, descriptions of main characteristics of seeds, main cultivation measures, adaptability and other conditions of use, risk warnings and related consulting services, and shall not make false or misleading propaganda.
No unit or individual may illegally interfere with the autonomy of seed producers and operators in production and operation.
