Will Xu Min's house come back?

I am back now, because Yao Ce has left, and we will wait and see what will happen. Yao Ce's adoptive mother, Jiangxi You, wrote in Weibo that she might sue Yao Ce and get the house they bought back. Yao Ce's family probably has no money because Yao Ce was ill and went to school since childhood and has no savings. They bought a house for Yao Ce and borrowed 200,000 yuan from Grandma Telemetry, so they didn't have much money to see Yao Ce and Xu Min's family. Min Xu's post in Weibo seems to have made a clean break with Yao Ce, saying that he would sue Xu Ce for the house, but there is a problem.

Yao Ce has lived with his adoptive parents for more than 20 years and has been living in the relationship between father and son. Therefore, in fact, even if Yao Ce is not their own child, it is a de facto adoption relationship. Their adoption relationship began at 1992, earlier than the Adoption Law and the recent enactment of the Civil Code in China. Neither the Adoption Law nor the Civil Law can be traced back, so their de facto adoption relationship can be legally recognized.

Since Yao Ce and Min Xu were adopted, and they are adopted mothers and adopted sons, Yao Ce has the right to inherit Xu Min's property. Regarding the mother-child relationship between Yao Ce and Min Xu, if Min Xu wants Yao Ce's only property back on the grounds that Yao Ce is an outsider, there may still be some legal problems, and the court may not necessarily support Xu Min's request.

In addition, the possibility of Guo Wei returning to Jiangxi is slim. Guo Wei has lived in Henan for more than 20 years, married and settled down to have children, and is a native of Henan. Even in ancient and modern China and foreign countries, few such biological children can return to their parents after many years. Guo Wei has been living a quiet life in Henan. He probably doesn't want his life to be disturbed. It is almost impossible for Guo Wei to return to Jiangxi.

After the adoptive mother and adopted daughter dissolve their relationship through the court and resume their relationship, they can inherit the inheritance.

Legal basis:

Article 10 of the Inheritance Law stipulates that inheritance shall be carried out in the following order:

First order: spouse, children, parents.

The second order: brothers and sisters, grandparents, grandparents.

After the inheritance begins, the successor in the first order inherits, and the successor in the second order does not inherit. If there is no successor in the first order, it is inherited by the successor in the second order.

Children referred to in this Law include children born in wedlock, children born out of wedlock, adopted children and stepchildren with dependency.

Parents referred to in this Law include biological parents, adoptive parents and step parents who have a dependency relationship.

Brothers and sisters referred to in this Law include brothers and sisters of the same parents, half-brothers, adopted brothers and sisters and stepbrothers and sisters with dependent relationship.
