This crime is a selective crime. According to the provisions of the Interpretation on Handling Criminal Cases of Illegal Publications, whoever commits the acts specified in Article 363 1 of the Criminal Law for the purpose of making profits shall be convicted and punished for the crime of making, copying, publishing, selling and disseminating obscene articles for profit:
(1) Make, copy and publish 50 to 100 obscene DVDs, 0 to 200 obscene tapes 100, 0 to 200 obscene poker, books, picture books 100 to 200 obscene photos and pictures.
(2) selling more than 200 obscene DVDs, software, videos 100, 200 to 400 obscene DVDs and tapes, 200 to 400 obscene DVDs and tapes, 200 to 400 obscene poker, books, picture books, and 0 to 2000 obscene photos and pictures 1000.
(3) Spreading obscene articles to others for more than 200 to 500 times, or organizing to play obscene movies and images/kloc-0 to 20 times or more.
(4) Making, reproducing, publishing, selling or disseminating obscene articles, and making a profit of not less than 5,000 yuan but not more than 10,000 yuan.
According to Article 363 1 of the Criminal Law, whoever commits this crime shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also be fined.
If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
Article 366 stipulates that if a unit commits this crime, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions on individual crime.
