For projects that have been completed and put into production, it is illegal to go through the formalities for examination and approval of soil and water conservation plans, and it is illegal to "build first and then approve". If the project has been put into operation for more than two years, the water administrative department may no longer require the production and construction unit to go through the formalities for examination and approval of the water and soil conservation plan. If it is not completed within two years, the water administrative department shall, in accordance with the provisions of Article 53 of the Soil and Water Conservation Law, order it to stop the illegal act and go through the formalities for examination and approval of the soil and water conservation plan within a time limit. Those who fail to go through the formalities within the time limit shall be punished by the water administrative department.
