Notice of Zhengzhou Municipal People's Government on Adjusting the Compensation Standard for the Relocation of Coal-pressed Villages

According to the Property Law of People's Republic of China (PRC), the Land Administration Law of the People's Republic of China and the Measures for Implementing the Land Administration Law of Henan Province, the expropriation of collectively owned land shall pay the land compensation fee, resettlement subsidy, ground attachments and young crops compensation fee in full according to law, and arrange social security fees for landless farmers to ensure their livelihood. In order to properly solve the problem of compensation for the relocation of coal mine villages in our city, ensure the production and life of coal mine enterprises and farmers in coal mine villages, and safeguard the economic interests of farmers in coal mine villages, the municipal government decided to adjust the compensation standards for various crops and ground attachments during the relocation of coal mine villages. The relevant issues are hereby notified as follows:

First, the compensation annual output value standard

1. According to the agricultural production level and price changes in our city, the compensation for cultivated land in the coal-pressing village is calculated according to the annual output value standard listed in the attached table 1.

2. The compensation fee for orchard land in Pressed Coal Village is calculated according to the annual output value standard listed in Schedule 2.

3. The compensation for fish ponds in coal mine villages is calculated according to the annual output value standards listed in Schedule 4; Fish pond facilities are compensated according to the ground attachments.

Two, the ground attachments according to the standard and the actual number of compensation listed in schedule five.

Three, this notice from the date of promulgation. Where the relevant provisions in the past are inconsistent with the contents of this notice, this notice shall prevail. Before the issuance of this notice, the determined compensation and resettlement plan for demolition will not be adjusted.

Four, counties (cities), the district can refer to the provisions of this notice.

Attached Table: Standard of Annual Output Value of Compensation for Various Crops (omitted)

note:

(a) the annual compensation standard for cotton, rice, peanuts, watermelons, tobacco leaves, oilseeds and other crops shall be calculated by increasing the annual compensation standard for similar cultivated land by 30%.

(two) the annual output value standard of lotus vegetable compensation is calculated by increasing the annual output value standard of similar cultivated land by 50%.

1. Land for food crops

The first type of cultivated land: flat and fertile land, complete irrigation and drainage facilities, drought and flood protection, stable and high yield;

Three types of cultivated land: the land is flat, relatively fertile, basically equipped with irrigation and drainage conditions, which can ensure the harvest;

Four types of cultivated land: flat land and poor soil quality;

Five types of cultivated land: hillside and hilly land, land with large slope and poor soil quality.

2. Vegetable fields

First-class land: the land is flat and fertile, with complete irrigation and drainage facilities, drought and flood protection, and vegetable planting 15 years or more;

Second-class land: the land is flat and fertile, the irrigation and drainage facilities are complete, the harvest is guaranteed in drought and flood, and vegetables have been planted for more than 10 years;

Three types of land: the land is flat and fertile, with irrigation and drainage facilities to ensure a bumper harvest, and vegetables have been planted for more than 7 years;

Four types of land: the land is flat and the soil quality is average, which can be irrigated and planted for more than 5 years;

Five types of land: flat land, poor soil quality and vegetable cultivation for less than 5 years.

note:

(a) apples, pears, peaches and other fruit trees, less than 20 per mu, not according to the orchard compensation. In addition to the particularly excellent tree species recommended and recognized by the relevant departments, if more than 120 plants are cultivated per mu, it will not be compensated according to the orchard.

(two) no compensation for vineyards with less than 200 grapes per mu. In addition to the special fine varieties recommended and recognized by the relevant departments, grapes above 0/000 per mu/kloc are not compensated by vineyards.

(3) Apple orchards, pear orchards, vineyards and peach orchards are compensated according to the list, and the compensation standard for fruit trees is shown in Schedule 3.

(A) the demolition of housing compensation standards

1. All kinds of house demolition compensation consider the expenses of old material loss, demolition, handling and new labor. The upper and lower limits of the compensation standard can be determined according to the price difference of local building materials and the old and new degree of the house.

2. The house is calculated according to the brick wall height of 24 cm and the cornice of 2.8 m, and the height increase or decrease can be compensated appropriately.

3. If the house has a cast-in-place part or a high decoration standard, the upper limit of the compensation standard shall be taken.

4. The relocation subsidy for the relocated population is calculated as 4 persons, and the 500 yuan of each household is increased by 1 person 100 yuan.

5. The gatehouse, kitchen, toilet and livestock pens can be compensated according to the cost.

6 roads, pipelines and other municipal public facilities shall be compensated according to the provisions of relevant departments and the actual situation.

(2) compensation standard of well and canal

1. Well compensation includes excavation engineering, materials and manual calculation. Cast iron pipe shaft can be compensated by increasing the material price difference with reference to concrete pipe shaft.

2. Waste and dry wells are compensated by 50% of the compensation standard for similar wells.

3. The canal compensation includes the disposal of old materials, material loss, demolition and construction costs, etc.

(3) Compensation standards for communication and power supply lines

1. The standard is calculated by tapered concrete pole, and the square concrete pole is compensated by 70% of the compensation fee of circular pole.

2. The compensation fee includes the removal fee of wires, fittings, cables and poles.

3. Each pole covers an area of 3 square meters, and the stay covers an area of 2 square meters. The tower covers an area of 15 times of the annual output value, and non-cultivated land without income will not be compensated.

(four) the standard of grave compensation includes the relocation fee and material fee for the buried workers.

(5) Brick kiln compensation standard

1. Brick kiln compensation is calculated according to the capacity of the kiln, the amount of kiln built, the required materials and labor costs.

2. Small ceramic kilns can be compensated according to the actual situation.
