Regulations of Benxi Municipality on Promoting Small and Medium-sized Enterprises

Chapter I General Provisions Article 1 In order to improve the business environment of small and medium-sized enterprises and promote their rapid and healthy development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Promotion of Small and Medium-sized Enterprises, the Regulations of Liaoning Province on Promoting the Development of Small and Medium-sized Enterprises and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the work of promoting the development of small and medium-sized enterprises within the administrative area of this Municipality.

The term "small and medium-sized enterprises" as mentioned in these Regulations refers to small and medium-sized enterprises and micro-enterprises of various ownership and forms that are legally established within the administrative area of this Municipality according to the national industrial policy, and whose production and operation scale meet the national standards for the classification of small and medium-sized enterprises. Article 3 The people's governments of cities and autonomous counties (districts) shall, in accordance with laws, regulations and relevant policies of the state, incorporate the development of small and medium-sized enterprises into the national economic and social development plan of the region, so as to create conditions and provide guarantee for the entrepreneurship and development of small and medium-sized enterprises.

The township (town) people's government should do a good job in guiding and serving the development of small and medium-sized enterprises. Fourth city, autonomous county (District) people's government departments in charge of small and medium-sized enterprises, responsible for the promotion of small and medium-sized enterprises in this area, perform the following duties according to law:

(a) to organize the implementation of national, provincial and local policies and plans on small and medium-sized enterprises;

(two) to promote the comprehensive coordination of the development of small and medium-sized enterprises in the region;

(three) to organize relevant departments to formulate the industrial guidance catalogue for the development of small and medium-sized enterprises;

(4) Organizing relevant departments to identify small and medium-sized enterprises;

(five) the use and management of special funds for the development of small and medium-sized enterprises;

(six) other duties entrusted by the people's governments of cities and autonomous counties (districts).

Development and reform, science and technology, finance, industry and commerce, land and resources, planning and construction, environmental protection, human resources and social security and other relevant departments should do a good job in promoting the development of small and medium-sized enterprises within their respective responsibilities. Fifth small and medium-sized enterprises enjoy the rights stipulated by laws and regulations, and no unit or individual may infringe upon the legitimate rights and interests of small and medium-sized enterprises.

Small and medium-sized enterprises shall strictly fulfill their legal obligations, operate legally, pay taxes according to law, be honest and trustworthy, and compete fairly, and shall not harm the public interests of the state and society or infringe upon the legitimate rights and interests of employees. Article 6 The people's governments of cities and autonomous counties (districts) shall commend and reward the units and individuals that have made outstanding contributions to the development of small and medium-sized enterprises. Chapter II Financial Support Article 7 The people's governments of cities and autonomous counties (districts) shall arrange special funds for the development of small and medium-sized enterprises in their fiscal budgets at the corresponding levels, and gradually increase them according to the financial growth at the corresponding levels.

The township (town) people's government may arrange special funds to support the development of small and medium-sized enterprises according to the actual situation or provide support for the development of small and medium-sized enterprises in other ways. Article 8 Special funds for the development of small and medium-sized enterprises shall be used to support the following matters:

(1) Supporting technological transformation of enterprises;

(2) Technological innovation and specialized new product development;

(three) energy saving and consumption reduction and cleaner production projects;

(four) resource conservation and comprehensive utilization projects;

(five) credit guarantee institutions that provide loan guarantees for small and medium-sized enterprises give risk compensation;

(six) SME service institutions to carry out personnel training, information consulting, entrepreneurship counseling and other services;

(seven) other matters to promote the development of small and medium-sized enterprises.

The financial and auditing departments shall regularly inspect and audit the management and use of special funds. Article 9 Financial institutions are encouraged to provide high-quality and efficient credit services for small and medium-sized enterprises in accordance with national industrial policies and credit policies.

Encourage financial institutions to strengthen cooperation with credit guarantee institutions, increase credit lines for qualified credit guarantee institutions, and give play to the role of guarantee institutions in financing services for SMEs. Tenth encourage and guide small loan companies, financing guarantee companies, rural banks and other new financial institutions to provide financial support for the entrepreneurial development, technological transformation and transformation of scientific and technological achievements of small and medium-sized enterprises. Eleventh to encourage and support small and medium-sized enterprises to enter the capital market. Guide qualified small and medium-sized enterprises to carry out direct financing activities in accordance with the law through financing channels such as equity, bonds, leasing and domestic and overseas listing. Chapter III Entrepreneurship Support Article 12 Guide and support the establishment of small and medium-sized enterprises that are scientific, entrepreneurial and labor-intensive. Focus on supporting small and medium-sized enterprises that are conducive to optimizing the industrial structure of our city and have characteristics and growth. Thirteenth improve the policy support system to encourage entrepreneurship, improve the entrepreneurial environment, reduce the cost of entrepreneurship, and provide financing, labor and social security policy support and services for small and medium-sized enterprises and entrepreneurs. Article 14 The people's governments of cities and autonomous counties (districts) shall arrange necessary land for the construction of small and medium-sized enterprises in urban and rural construction planning, encourage all kinds of social capital to invest in the construction of small and medium-sized enterprise entrepreneurship bases, or use idle factories and sites to establish small and medium-sized enterprise incubation bases to provide production and business places for entrepreneurial enterprises. Article 15 Small and medium-sized enterprises that have absorbed laid-off workers and placed disabled people in the proportion stipulated by the state, small and medium-sized enterprises that meet the state's policy of supporting and encouraging development, and various service institutions serving small and medium-sized enterprises enjoy preferential tax and fee policies in accordance with relevant regulations. Sixteenth to encourage small and medium-sized enterprises to create jobs. Small and medium-sized enterprises that meet the employment-related conditions should be given financial support to promote employment.
