Provisions of Guangzhou Municipality on the Administration of Public Credit Information

Chapter I General Provisions Article 1 In order to regulate the collection, disclosure and use of public credit information, ensure the safety of public credit information, protect the legitimate rights and interests of natural persons, legal persons and unincorporated organizations, optimize the business environment and create an honest and trustworthy social environment, these Provisions are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on the Openness of Information and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "public credit information" as mentioned in these Provisions refers to the data and materials generated or obtained by the administrative organs of this Municipality and organizations authorized by laws and regulations to manage public affairs (hereinafter referred to as information providers) in the process of performing their duties and providing public services, which are confirmed in legal form and can be used to identify the credit status of natural persons, legal persons or unincorporated organizations (hereinafter referred to as information subjects). Article 3 These Provisions shall apply to the collection, disclosure, use, repair and management of public credit information within the administrative area of this Municipality.

These Provisions shall apply to the credit information collected by the municipal competent credit information department from the people's courts, customs and other state organs and institutions and the credit information enjoyed by the above-mentioned units in accordance with the relevant provisions. Article 4 The collection, disclosure and use of public credit information shall follow the principles of legality, safety, timeliness and accuracy, protect the legitimate rights and interests of information subjects, and shall not disclose state secrets or infringe on business secrets and personal privacy. Article 5 The municipal and district people's governments shall strengthen the organization and leadership of public credit information work in their respective administrative areas, incorporate the required funds into the fiscal budget, and incorporate public credit information into the construction of the city's social credit system and market supervision system.

The municipal and district people's governments shall study and coordinate major issues in the management of public credit information through the coordination mechanism of social credit system construction. Article 6 The Municipal Development and Reform Department is the competent department of public credit information work in this Municipality, responsible for overall planning, comprehensive coordination, guidance and supervision of the collection, disclosure, use, repair, supervision and management of public credit information in this Municipality, and responsible for organizing the implementation of these Provisions.

The competent department of informatization of the municipal government shall co-ordinate and guide the construction, management and maintenance of the municipal public credit information management system, and formulate unified technical standards such as data format and data interface of public credit information and management norms for public credit information collection.

The relevant administrative departments shall, in accordance with their respective responsibilities, cooperate with the management of public credit information. Article 7 This Municipality shall establish a public credit information management system in this Municipality, and collect the public credit information covering natural persons, legal persons and unincorporated organizations in this Municipality in a unified way, and make it available to the public through Credit Guangzhou Network.

City public credit information management system should rely on the city's unified government information sharing platform, and financial credit information basic database, enterprise credit information publicity system and other related credit information systems to achieve cross-departmental, cross-industry and cross-regional exchange and sharing of public credit information. Chapter II Collection of Public Credit Information Article 8 Public credit information shall be subject to directory management. The catalogue of public credit information shall be compiled and updated by the municipal government information department in conjunction with the municipal development and reform department. After soliciting the opinions of relevant units, it shall be reported to the Municipal People's government for approval and announced to the public.

The catalogue of public credit information shall include the providers of public credit information, information categories, information subjects, indicators, disclosure methods and disclosure periods.

The information categories of public credit information are divided into basic information, trustworthy information, untrustworthy information and prompt information.

Public credit information disclosure methods include publicity, inquiry and government affairs disclosure. Article 9 This Municipality shall establish a comprehensive, stable, unified and unique one-code system for public credit codes.

The collection of natural person's credit information takes the resident ID number or other valid ID number as the unique identification of the associated matching credit information; The collection of public credit information of legal persons and unincorporated organizations takes the unified social credit code as the unique identification of associated matching credit information. Article 10 The basic information of an information subject includes the following contents:

(a) the name of the natural person, resident identity card or other valid identification number;

(two) the name of the legal person and the organization without legal personality, the name of the legal representative or person in charge, and the unified social credit code. Article 11 The credible information of the information subject includes the following contents:

(1) Information such as commendations and awards given by administrative organs and organizations authorized by laws and regulations to manage public affairs;

(2) Information with excellent credit rating of organizations authorized by administrative organs and laws and regulations with the function of managing public affairs;

(three) compliance with the credit commitments of administrative organs and organizations authorized by laws and regulations to manage public affairs;

(4) Information such as charitable donation activities;

(five) to participate in the voluntary service and other information carried out by administrative organs and organizations authorized by laws and regulations with the function of managing public affairs;

(six) other trustworthy information as stipulated by laws, regulations and rules. Article 12 The untrustworthy information of the information subject includes the following contents:

(1) Information on administrative punishment made by applying general procedures;

(2) Information enforced by administrative organs and organizations authorized by laws and regulations to manage public affairs according to law;

(3) Information on the effective judgment of the people's court;

(four) refusing to implement the legal documents that have come into effect by the people's courts and arbitration institutions, and entering the execution procedures according to law;

(5) Bad credit information assessed by administrative organs and organizations authorized by laws and regulations to manage public affairs;

(6) Providing false information to an administrative organ or an organization authorized by laws and regulations to manage public affairs;

(seven) unpaid water, electricity, gas and other public utilities fees without justifiable reasons, and the amount is relatively large, and has not been paid for more than six months after being urged;

(eight) information that violates the credit commitment made by the administrative organs and organizations authorized by laws and regulations to manage public affairs;

(nine) the information that administrative organs and organizations authorized by laws and regulations with the function of managing public affairs are prohibited from entering the industry according to law;

(ten) other untrustworthy information as stipulated by laws, regulations and rules.
