The All-China Federation of Industry and Commerce is a people's organization and chamber of commerce in China led by China's * * * production party. It is a bridge between the party and the government to contact people in the non-public economy and an assistant to the government in managing the non-public economy.
Based on the Constitution of People's Republic of China (PRC), the Association carries out its work in accordance with its articles of association.
Holding high the great banner of Socialism with Chinese characteristics, guided by Deng Xiaoping Theory and Theory of Three Represents, the Association thoroughly implemented Scientific Outlook on Development, adhered to the Party's basic line in the primary stage of socialism, adhered to the basic economic system with public ownership as the main body and multiple ownership economies developing together, and continued to emancipate the mind, persist in reform and opening up, promote scientific development, promote social harmony, serve the overall work of the Party and the state, serve party member, guide the healthy growth of non-public economic people and promote the healthy development of the non-public economy.
This association has the characteristics of United front, economy and folk. Give full play to the role of non-public economic people as the main channel to participate in political and social affairs, the important role of non-public economic people in ideological and political work, the auxiliary role of the government in managing the non-public economy, the coordination role in the process of building harmonious labor relations, and the positive role of the reform and development of trade associations and chambers of commerce.
According to the working policy of full respect, extensive contacts, strengthening unity, enthusiastic help and active guidance, the Association educates its members to firmly support the leadership of the China Producer Party, firmly follow the Socialism with Chinese characteristics road, and organizes its members to actively participate in socialist economic construction, political construction, cultural construction and social construction, so as to promote the reunification of the motherland and strive to build China into a prosperous, strong, democratic, civilized and harmonious socialist modern country.
Chapter I Functions and Tasks
Article 1 Participate in political consultations on major national policies and important issues in political, economic and social life, give play to the role of democratic supervision, and actively participate in the discussion of state affairs.
Article 2 Close contact with members, smooth the channels for reflecting opinions and suggestions, commend and publicize advanced models among members, and do a good job in recommending political arrangements for business representatives.
Third, strengthen and improve the ideological and political work of non-public economic people.
Guide members to build a socialist core value system, establish the Socialism with Chinese characteristics ideal, study and implement the principles and policies of the party and the state, carry forward the fine tradition of self-education, consciously combine the development of their own enterprises with the development of the country, combine personal prosperity with the prosperity of all the people, and combine following market rules with promoting socialist morality to achieve patriotism, dedication, honesty, law-abiding and contribution.
Guide members to carry forward the traditional virtues of the Chinese nation, be rich and think about the source, and then make progress, actively assume social responsibilities, be enthusiastic about public welfare undertakings, and devote themselves to glorious undertakings. Strengthen the construction of corporate culture and support the construction of party building and trade unions in enterprises.
Article 4 According to the requirements of Scientific Outlook on Development, guide members to change the mode of economic development, strengthen energy and resource conservation, attach importance to ecological environment protection, and establish harmonious labor relations. Abide by national laws and regulations, standardize business practices, pay taxes according to regulations, establish a modern enterprise system, and maintain market economic order.
Fifth represent and safeguard the legitimate rights and interests of members, reflect the opinions, demands and suggestions of members, and participate in mediation and arbitration of economic disputes.
Article 6 Provide training, financing, science and technology, law, information consultation and other services for members, provide domestic and international economic and trade exchange services, and provide public relations communication and coordination services to help members enhance their independent innovation ability and improve their core competitiveness and sustainable development ability.
Article 7 Strengthen contacts with businessmen from Hongkong, Macao Special Administrative Region and Taiwan Province Province, and carry out the work of promoting economic and trade cooperation and promoting the reunification of the motherland; Strengthen exchanges with foreign federations of industry and commerce, and serve the country's opening wider to the outside world and enterprises' entry into the international market.
Eighth to strengthen self-construction, reflect the characteristics, improve the ability to perform their duties and play a role, enhance cohesion.
Article 9 Strengthen production management according to law.
Tenth to undertake matters entrusted by the government and relevant departments.
Chapter II Members
Article 11 Enterprises, organizations and individuals that recognize the articles of association and fulfill their membership obligations may apply to join the association.
(a) after the application for membership of various enterprises is approved, it is the enterprise member of this association.
The main bodies of enterprises are non-public enterprises, including private enterprises, private scientific and technological enterprises, enterprises invested by overseas Chinese from Hong Kong, Macao and Taiwan, limited liability companies and joint-stock companies with non-public economic components as the mainstay, and intermediary service agencies.
(2) The Federation of Industry and Commerce and other relevant social organizations with legal person status shall be group members of the Association after their applications for membership are approved.
(three) investors and operators of industrial and commercial enterprises and individual industrial and commercial households. After the application for membership is approved, it will be an individual member of the association;
People related to our work, Hong Kong compatriots, Macao compatriots, Taiwan Province compatriots and overseas Chinese can apply for or be invited to become individual members of our association;
Units that have established working contacts with this Association may send representatives to participate in this Association as individual members through consultation;
The former businessmen were all individual members of this association.
Twelfth the principle of voluntary membership and free withdrawal.
The federations of industry and commerce at all levels may, according to the articles of association and the actual situation, formulate specific membership conditions and procedures for joining or withdrawing, and report them to the federation of industry and commerce at the next higher level for the record.
Thirteenth members in violation of the articles of association or criminal law, the association can decide to suspend or cancel its membership.
Article 14 Members of local federations of industry and commerce at all levels are also members of superior federations of industry and commerce.
Article 15 Members of this Association shall enjoy the following rights:
(a) Have the right to vote, vote and be elected within the Association;
(two) to reflect opinions, demands and suggestions to this Council and criticize the work of this Council;
(three) to participate in the activities of this association;
(4) Enjoy the services provided by this Association;
(5) Require FSC to safeguard its legitimate rights and interests.
Article 16 Members of this Association have the following obligations:
(1) Abide by the articles of association;
(two) to implement the resolutions of this Council;
(3) Paying membership fees according to regulations;
(4) Caring for and supporting the work of this Association;
(five) accept the supervision of this association;
(6) Handling matters entrusted by FSC.
Chapter III Organization
Article 17 Associations are organized according to national administrative divisions: All-China Federation of Industry and Commerce is a national organization; Federation of Industry and Commerce of provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps, Federation of Industry and Commerce of prefecture-level cities (regions, autonomous prefectures, leagues and municipalities directly under the Central Government), and Federation of Industry and Commerce of county-level cities (counties, banners and municipalities directly under the Central Government) are local organizations; The Federation of Industry and Commerce established in streets, communities and towns is a grass-roots organization.
Article 18 The Federation of Industry and Commerce may set up trade associations or chambers of commerce according to industries, with the Federation of Industry and Commerce at the same level as its competent business unit.
Article 19 The organizing principle of this Association is democratic centralism. The higher level Federation of Industry and Commerce has a guiding relationship with the lower level Federation of Industry and Commerce.
Twentieth the highest authority of the Federation of Industry and Commerce at all levels is the member congresses at all levels or the member congresses. Its functions and powers are:
(a) to discuss and decide on major issues of the Association;
(2) Hearing and deliberating the report of the Executive Committee;
(3) Electing the Executive Committee;
(4) Deciding on other important matters.
The National Federation of Industry and Commerce Congress is also responsible for amending the articles of association.
Twenty-first federations of industry and commerce at all levels hold a member congress or a member congress every five years. If necessary, the meeting can be held in advance or postponed.
Member congresses at all levels or member congresses shall be convened by the Executive Committee. During the congress, the elected presidium shall preside over the meeting.
Twenty-second representatives of member congresses of federations of industry and commerce at all levels shall be elected by members through consultation, and some representatives may be invited to participate if necessary.
The number of deputies to the Congress and the allocation method shall be decided by the executive committee or the authorized standing committee.
Article 23 The Executive Committee of the Federation of Industry and Commerce at all levels is the highest leading organ of the Federation of Industry and Commerce at all levels when the members' congress is not in session, and its functions and powers are:
(a) to implement the resolutions of the general meeting of members or the general meeting of members;
(two) to hear and consider the report of the Standing Committee;
(three) to discuss and decide on the working principles and tasks of this association;
(4) Electing the chairman, vice-chairmen and standing committee members.
The term of office of the Executive Committee is five years, and a plenary meeting is held every year.
The allocation and selection of members of the next Executive Committee shall be decided by the last Executive Committee or the authorized Standing Committee.
Twenty-fourth members of the Executive Committee at all levels shall bear the responsibilities and fulfill the obligations of members:
(a) adhere to the correct political direction and conscientiously implement the party's line, principles and policies;
(two) to play the role of participating in the discussion of state affairs and put forward suggestions on important issues in economic and social development;
(three) love the work of the Federation of Industry and Commerce, attend the meeting of the Executive Committee, and participate in the important activities of the organization;
(4) Implementing the resolutions of the Federation of Industry and Commerce;
(five) extensive contact with members, reflect the opinions and demands of members;
(six) to put forward opinions and suggestions on the work of this association.
Article 25 The Standing Committee consists of the chairman, vice-chairmen and standing committee members. Each term of office is the same as that of the Executive Committee, and the functions and powers of the Executive Committee are exercised when the Executive Committee is not in session:
(1) Implementing the resolutions of the Executive Committee;
(two) to discuss and study the principles and tasks of the Association;
(3) Be responsible and report to the Executive Committee.
The meeting of the Standing Committee is held twice a year.
The allocation and appointment of the number of members of the next Standing Committee shall be decided by the previous Standing Committee or the authorized Standing Committee.
County-level cities (counties, banners, districts under the jurisdiction of provincial cities) and grassroots organizations of the Federation of Industry and Commerce decide whether to set up a standing committee as the case may be.
Article 26 The chairman shall preside over the meeting and the vice chairman shall assist the chairman in his work. The chairman and vice-chairman form a chairman's meeting to study and decide on major issues.
The vice-chairmen are divided into full-time vice-chairmen and part-time vice-chairmen. In principle, full-time vice-chairmen shall not be re-elected for more than two terms. In principle, the part-time vice-chairman of the All-China Federation of Industry and Commerce does not serve continuously, and the part-time vice-chairman of the local Federation of Industry and Commerce does not serve for more than two consecutive terms.
The All-China Federation of Industry and Commerce and the Federation of Industry and Commerce of provinces, autonomous regions and municipalities directly under the Central Government may have a first vice-chairman and an executive vice-chairman.
The executive vice-chairmen of the Federation of Industry and Commerce of provinces, autonomous regions and municipalities directly under the Central Government shall be nominated by the chairman and adopted by the Standing Committee. The executive vice president assisted the chairman in presiding over the meeting.
The leading bodies and leaders produced by each Executive Committee will continue to preside over the regular work during the next congress or general meeting until the next Executive Committee produces new leading bodies and leaders.
Article 27 The secretaries-general of local federations of industry and commerce at all levels are elected by the executive committees at the corresponding levels and are members of the standing committees and chairmen's meetings at the corresponding levels.
Twenty-eighth executive committees and standing committees of federations of industry and commerce at all levels may make adjustments during the intersessional period. The adjusted personnel shall be approved by the Standing Committee and submitted to the Executive Committee for confirmation.
Local federations of industry and commerce at all levels shall report the preparations to the federation of industry and commerce at the next higher level, and the election results shall be reported to the federation of industry and commerce at the next higher level for the record.
Twenty-ninth federations of industry and commerce at all levels shall set up working departments and special committees according to the needs of their work.
Thirtieth the newly established local Federation of Industry and Commerce shall be reported to the Party committee at the same level for approval, and reported to the Federation of Industry and Commerce at the next higher level for the record.
Article 31 The All-China Federation of Industry and Commerce is also called China Folk Chamber of Commerce, and the local Federation of Industry and Commerce is also an organization of local folk chambers of commerce.
Chairman of the Federation of Industry and Commerce concurrently. In principle, the vice-chairman shall be the full-time vice-chairman of the Federation of Industry and Commerce, the part-time vice-chairman of the last Federation of Industry and Commerce and qualified representatives of the non-public economy. The chairman and vice-chairman are elected by the executive Committee of the Federation of Industry and Commerce.
In principle, the non-public economic representatives among the vice-presidents of China folk chamber of commerce do not serve continuously, and the vice-presidents of local folk chambers of commerce serve for no more than two consecutive terms.
Chapter IV Staff
Thirty-second federations of industry and commerce at all levels shall abide by the provisions of the Civil Service Law of People's Republic of China (PRC), strengthen the management and supervision of national civil servants, and build a high-quality civil servant team.
Thirty-third staff of the Federation of Industry and Commerce at all levels shall:
(1) Hold high the great banner of Socialism with Chinese characteristics, earnestly study Marxism–Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents, study Scientific Outlook on Development, learn politics, economy, science and technology, culture, law and professional knowledge, and have the theoretical, policy and professional level required to perform their duties;
(two) establish Socialism with Chinese characteristics's firm belief, have a strong sense of professionalism and responsibility, love the cause of the Federation of Industry and Commerce, emancipate the mind, be brave in innovation, be loyal to their duties, work hard and enhance their working ability;
(3) Persist in seeking truth from facts, establish a good style of work, keep close contact with members and be good at unity;
(four) be strict with yourself, diligent and honest, take the overall situation into account, observe discipline, and consciously accept the supervision of organizations and members.
Chapter V Emblem
Article 34 The emblem of the All-China Federation of Industry and Commerce is a pattern composed of bridges and ties.
Article 35 The emblem of the All-China Federation of Industry and Commerce can be worn as the emblem; It can be hung in offices, activity places and meeting places organized by the Federation of Industry and Commerce; Can be used as a sign on souvenirs and office supplies; It shall not be used for commercial purposes without authorization.
Chapter VI Supplementary Provisions
Article 36 These Articles of Association are the unified articles of association of the national federations of industry and commerce (non-governmental chambers of commerce) at all levels, which were adopted by the member congresses of the National Federation of Industry and Commerce and reported to the State Council for the record.
Article 37 The right to interpret these Articles of Association belongs to the All-China Federation of Industry and Commerce.
