In China, copyright begins on the date the work is created. Copyright registration is not a prerequisite for obtaining copyright, but the copyright registration certification document is a kind of registration matter and a preliminary proof of the registration matter. It can be used as a certification document to claim rights or file administrative settlement or litigation of rights disputes. Computer software can be registered by the China Copyright Protection Center; other original works: writing, art, photography, movies, music, architectural works and engineering design drawings, etc., can be registered by the provincial copyright registration department. In some countries, if the work has not been published, the provincial copyright registration department may be responsible for registering it. If the work is not registered, there will be some adverse consequences. The primary issue at the moment is whether you can produce the manuscript at the time of creation to prove that it was created by you and not someone else, and if there is someone who collaborated, he must issue relevant certificates. Otherwise, You may face the risk of being sued. It will not cost you much to consult the China Copyright Protection Network and the Provincial Cultural Bureau.
2. Material requirements:
Materials and requirements that should be submitted when applying for copyright registration of works:
(1) Complete the application form for copyright registration of works as required ;
(2) Proof of identity of the applicant;
(3) Proof of ownership of rights;
(4) Sample of the work (can be submitted on paper media or Samples of electronic media works);
(5) Description of the work (please write from three aspects: creative intention, creative process, and originality, and signed by the author);
(6) Entrust others When applying on behalf of the applicant, the agent should submit a letter of authorization from the applicant;
(7) Proof of identity of the agent.
3. Processing steps:
The applicant submits registration application materials - the registration agency verifies the received materials - notifies payment - the applicant pays the registration fee - the registration agency accepts the application - review - production Issuance of Registration Certificate—Announcement.
4. Processing time limit:
The registration application will be processed within 30 working days after the registration agency accepts it. If supplements and corrections are required, the applicant shall complete the supplements and corrections within two months after receiving the notice of supplements and corrections, and the registration agency shall complete the process within 30 working days after receiving the supplements and corrections that meet the requirements.
5. Payment requirements:
Applicants who apply for copyright registration of works should pay fees according to regulations.
After receiving the payment notice, the applicant should go directly to the CPCC Copyright Registration Hall to pay the fee to the Finance Office of China Copyright Protection Center within 10 days, or through a bank. When remitting the registration fee, the title of the work and the application serial number should be stated in the remittance form.
