Regulations of China Municipality on the Administration of Microbial Preservation

Chapter I General Provisions Article 1 Microbiology plays an important role in modern biology. With the development of China's socialist construction, it plays an increasingly important role in agriculture, forestry, animal husbandry, fishery, light industry, chemical industry, mining, environmental protection, medicine and health and national defense. Strain is the basic material for microbial research and application, one of the important basic conditions for developing bioengineering, and an important national biological resource. In order to further improve the separation and screening, collection and preservation, identification and cataloging, and supply exchange of strains, and better serve the four modernizations, these management regulations are formulated. Article 2 The term "strains" as mentioned in these Regulations includes representative strains such as culturable bacteria, fungi, viruses and cells with certain scientific significance or practical value. Article 3 The China Microbial Germplasm Resources Preservation Committee consists of general microorganisms, agricultural microorganisms, forestry microorganisms, industrial microorganisms, antibiotic microorganisms, medical microorganisms and veterinary microorganisms preservation centers. Chapter II Collection and Preservation Article 4 Collection

(1) Each preservation management center has the right to collect and obtain valuable strains from relevant domestic units.

(2) Where a unit or individual separates, cultivates or introduces a strain with certain value, it shall submit the duplicate culture and detailed information of the strain to the relevant preservation management center in time. Only those who are confirmed to be of preservation value can enter Tibet.

(3) The following strains are all important national biological resources, and they need to go through the formalities of entering Tibet at the relevant center.

1. Patent-applied strain;

2 strains involved in scientific research results reported to the Ministry and provinces, autonomous regions and municipalities directly under the central government;

3. New species and strains. Article 5 Preservation

(1) The strains preserved by the Preservation Management Center must have detailed strains history and relevant experimental data.

(2) The preservation management centers should adopt appropriate and reliable methods to preserve the strains they are responsible for, so as to avoid strain pollution or death.

(three) the preservation management center shall formulate a safe and strict storage system, and designate a person to be responsible for it.

(four) the preservation management center should respect the work achievements of the units or individuals applying for preservation, and testify for * * *, safeguard their legitimate rights and interests, and shall not spread it without authorization. Chapter III Naming and Cataloguing Article 6 Naming

The academic group of the Committee is responsible for classification and naming, unified translation and other matters, and relevant parties will cooperate. Article 7 Cataloging

(1) The catalogue of strains is the main basis for the state to master biological resources. Therefore, under the leadership of the Committee, relevant personnel were organized to compile or revise the following catalogues:

1. China strain directory;

2. Catalogue of strains in each preservation management center;

3 national patent or confidential strain directory;

4. The necessary catalogue of other strains.

(two) the preservation management center shall report the newly collected strains to the Committee on the designated date every year for regular notification.

(3) No unit or individual may change the strain number of the strains listed in the Catalogue of China Strains without authorization. Chapter IV Supply and Exchange Article 8 Domestic supply

(a) when each unit needs strains, it must issue an official letter stating the name, serial number, model, quantity and purpose of strains. When users obtain the results of in-depth research on strains provided by relevant preservation institutions, they should indicate the units providing strains in the results report.

(2) All strains allowed by the state to be mailed must be tightly packed in accordance with relevant regulations.

(3) Pathogenic microorganisms, antibiotic-producing strains and confidential strains that are infectious to humans, animals and plants shall be supplied and used in strict accordance with corresponding management measures. Article 9 International communication

(1) When domestic strains that have not been preserved need to be imported from abroad, the unit shall prepare a list in Chinese and English (including the name, species, strain number, name and address of the country where they are located and the depositary unit) in triplicate, and submit it to the relevant preservation center for handling after being approved by the competent departments of provinces, municipalities and autonomous regions.

(2) When a unit or individual acquires or exchanges strains from abroad, it shall promptly send a copy of the strain or its culture together with the materials to the relevant preservation management center for preservation.

(3) The introduction of pathogenic microorganism drugs, animal and plant strains with high pathogenicity from abroad that have not been found in China shall be approved by the competent department in advance.

(4) When foreign countries ask for strains from China, the units responsible for supply shall handle them according to the Measures for the Administration of Biological Resources Export in People's Republic of China (PRC) issued by the State Science and Technology Commission. Chapter V Awards and Penalties Article 10 Units and individuals that have made outstanding contributions to the screening, preservation and management of strains shall be given moral or material awards; If harm or loss is caused by improper management of strain preservation, necessary punishment shall be given according to different situations. Chapter VI Supplementary Provisions Article 11 These Regulations shall come into force after being approved by the State Science and Technology Commission. Article 12 The detailed rules for the implementation of these Regulations shall be formulated by the strain preservation management center, implemented after being approved by the competent department, and reported to the strain preservation committee for the record.
