I. Revision of Chapter VII of Part V

The fifth part, Chapter 7, Section 2.3 is amended as follows:

"2.3 Calculation of time limit

If the term is calculated in years or months, the corresponding date of the last 1 month shall be the expiration date of the term; If there is no corresponding day in the current month, the last 1 day of the current month shall be the due date. For example, the filing date of 1 invention patent application is 1 June, 998 1, and the expiration date of substantive examination request should be 2001June1,instead of 2001May 3 1. If the notice stipulates that the time limit is 2 months, the expiration date of the time limit shall be February 29, 2000.

If the due date is a legal holiday, the due date shall be 1 working day after the holiday. Statutory holidays include all citizens' holidays as stipulated in Article 2 of the National Holidays and Remembrance Day Holidays Measures issued by the State Council, and weekly rest days as stipulated in Article 7, paragraph 1, of the Regulations on Working Hours of Employees in the State Council. If the state announces the suspension, the date after the suspension shall prevail. For example, the filing date of a patent application is 65438+20071October 30th, and the closing date of the application fee should be 65438+20081October 2nd (according to the notice of the State Council General Office, 65438+February 30th, 2007 -65438+2008/KLOC). Another example is that the filing date of the patent application is 65438+February 6, 2007, and the due date of the application fee should be 65438 February+March 2008 (according to the notice of the General Office of the State Council, February 6-65438+February 2008 is a holiday). "

The original provision of the Review Guide is an explanation of the time limit calculation according to the relevant national holiday regulations at that time. Since the State Council revised the National Holidays and Remembrance Days on June 5438+February 65438+April 2007, Tomb-Sweeping Day, Dragon Boat Festival and Mid-Autumn Festival were added as holidays, and the Labor Day holiday was reduced to 1 day, so it is necessary to modify the original regulations.

By quoting the relevant provisions of relevant administrative regulations, the revised regulations more clearly explain the basis for determining legal holidays, which is more stable, and there is no need to make corresponding amendments when revising relevant administrative regulations in the future.
