Shijiazhuang new regulations: these 14 types of rural property rights can be traded in the market.

On November 1th, Phoenix Net Real Estate learned from Shijiazhuang Government that in order to further promote the construction of rural property rights transfer trading market in Shijiazhuang, standardize rural property rights transfer trading behavior, promote the orderly flow of rural production factors, give play to the role of market in allocating rural resources, and effectively consolidate the policy foundation of rural property rights transactions, recently, the Shijiazhuang Municipal Government Office issued "The Office of Shijiazhuang Municipal People's Government on Printing and Distributing <: Measures for the administration of rural property rights transfer transactions in Shijiazhuang > < Detailed Rules for the Implementation of Rural Collective Assets Circulation Transaction in Shijiazhuang City > Notice "(Shi Zhengban letter [221] No.49) (hereinafter referred to as the" Measures "and" Detailed Rules "), and the" Measures "and" Detailed Rules "shall come into force as of the date of issuance (release).

The Measures specify that 14 types of rural property rights, such as contracted land management right, forest right and "four wastes" use right, can be traded in the market. The varieties of rural property rights transfer transactions include

(1) the right of farmers to contract land management. That is, the management rights of cultivated land, grassland and aquaculture water surface contracted by household contract.

(2) forest right. That is, the management right of rural collective forest land and the ownership and use right of forest trees.

(3) the right to use the "four wastes". That is, the right to use wasteland, barren ditch, barren hill and barren beach owned by rural collectives.

(4) Rural collective operating assets. That is, the ownership and use right of operating assets (excluding land) managed by rural collectives.

(5) the right to use rural collective resource assets. That is, the right to use resource assets such as land, woodland, forest, mountains, grasslands, wasteland and beaches owned by rural collectives.

(6) Equity of rural collective assets. That is, the rural collective operating assets (net assets) are converted into shares to quantify the number of shares of collective assets held by each member (shareholder) of the collective economic organization.

(7) agricultural productive facilities and equipment. That is, agricultural production facilities and equipment owned by farmers, farmers' cooperative organizations, rural collectives and agricultural enterprises.

(8) the right to use small water conservancy facilities. That is, the right to use small water conservancy facilities owned by farmers, farmers' cooperative organizations, rural collectives and agriculture-related enterprises.

(9) agricultural intellectual property rights. That is, agricultural patents, trademarks, copyrights, new varieties, new technologies, etc.

(1) Rural homestead use right and housing property right. That is, the right to use the rural homestead and the ownership and right to use the house on the homestead.

(11) Rural biological assets. That is, consumable biological assets such as growing field crops, vegetables, timber forests and livestock on hand for sale, and productive biological assets such as economic forests, firewood forests, livestock production and draught animals.

(13) other rural property rights such as bidding for rural construction projects, investment invitation and transfer of industrial projects. (14) other trading varieties permitted by policies and regulations.

The Detailed Rules show that rural collective assets and resources must be traded, transferred and sublet, sold and lent, mortgaged, scrapped and reported for loss, including changes in ownership, use right or management right, which must be conducted openly through the rural property rights trading center. The scope of rural collective assets includes: the right to operate farmland, "four barren" land, woodland, grassland, water surface, beach and other land owned by rural collectives according to the law, and the right to use collective construction land such as economic development land.

The document clearly points out that rural property rights transfer market must adhere to the purpose of serving agriculture, highlight public welfare, and not aim at making profits. Rural collective assets transfer transactions, rural collective construction procurement projects bidding, rural collective bulk investment projects must be carried out through the rural property rights trading platform, to encourage and guide rural property rights owned by farmers to enter the open market circulation transactions.

governments of counties (cities, districts) should take the certificate of rural property rights transfer transaction as the basis for the standardized use of funds for rural collective assets disposal, transfer, lease and collective construction and procurement projects, further improve the village-level financial management system, and supervise the effective docking of the rural agricultural financial management system and the entry transaction system.
