According to the evaluation results, if the complaint is unreasonable, a complaint or counter-notice shall be written; If his complaint is reasonable, he should take the initiative to contact the complainant and try to withdraw the complaint. Take the design patent as an example, you can submit the following information:
1. The design patent applied by the other party is an existing design: a. Make public the sales records before the filing date of the complainant's patent (provide the order numbers of Alibaba and Taobao, and the pictures displayed in the order are consistent with the complainant's patent view); B. Other materials that affect the patent stability of the complainant (screenshots of web pages, documents, brochures, patent materials before the filing date, etc.);
2. Contrastive description of the inconsistency between the goods sold and the complainant's patent: it is necessary to provide a picture of the complained goods page to compare with the complainant's patent view and design points, including shape, pattern and color, and it is suggested to point out the differences by combining pictures and texts;
3. raise reasonable questions about the stability of the complainant's patent: invalidation decision/confirmation of non-infringement decision;
4. The products sold come from the complainant: the complete authorization chain or purchase certificate from the obligee;
5. If the above four points fail, you can directly apply to China National Intellectual Property Administration for patent invalidation.
