Behind the soaring DJI drone

After Grain Rain, early rice in South China reached the critical period of tillering and fertilization. In Jiaokeng Village, Zhoutian Town, Renhua County, Shaoguan City, northern Guangdong Province, a drone slowly took off and circled over the endless rice fields, and the fertilizer was evenly spread.

Timely application of tillering fertilizer, with many branches and high yield, is the most important fertilization link for farmers.

"This is the DJI T20P UAV, with a wing width of 3 meters, 10 minutes to complete 10 mu of field." Deng Ruiting, a large local planter, pointed to the hovering drone and said: "DJI can fertilize 300 A Mu a day, which is equivalent to 30 strong laborers, fast and even."

DJI T20P UAV is an agricultural UAV which was put into mass production by Shenzhen DJI Innovation Technology Co., Ltd. in June165438+1October last year.

As a private high-tech enterprise in Guangdong, DJI Company has grown from a small team of four people to a large company with more than 4,000 employees in 16 years. At present, more than 13000 patents have been applied, and the products are distributed in more than 100 countries, with a global market share of over 80%.

"The development of DJI is not only the result of R&D's increased investment, but also the guidance of Guangdong's policy of strengthening the province by science and technology, and it is also inseparable from the strong guarantee of the judiciary for scientific and technological innovation." Cui Mingyuan, the legal representative of DJI, said this.

"Pre-judgment"

Let innovators really win the market.

One end of intellectual property is connected with innovation, and the other end is connected with the market. Rapid rights protection is just needed for the healthy development of innovative enterprises, and it is also the proper meaning of judicial protection innovation.

"Pan-tilt camera" is a new technology independently developed by DJI company, which can automatically and stably shoot, and its products are favored by the market after listing. On February 20 18, 18, China National Intellectual Property Administration granted the design patent, and then the technology won the 2 1 China design patent gold medal.

In order to find out the facts as soon as possible, the court asked technical investigators to give professional opinions, and also coordinated the opinions issued by the National Intellectual Property Patent Examination and Cooperation Center.

"As an innovative enterprise, it is particularly urgent to safeguard rights quickly." Wang Xiaodan, then head of the intellectual property department of DJI Company, said that general intellectual property litigation needs more than 1 year, and even if it wins, it may lose the market. "First-instance judgment+temporary injunction" has well solved the problem of "winning the lawsuit and losing the market" in patent rights protection.

"Top Case" Award and Compensation-

20 16, 10 In June, DJI's "Yuntai" technology was awarded the invention patent by China National Intellectual Property Administration, and was later awarded the fourth Guangdong Patent Gold Award and the 19 China Patent Excellence Award. 2065438+February 2007, DJI Company found that the "Zhiyun Shaping" triaxial stabilizer produced and sold by Guilin Shen Zhi Information Technology Co., Ltd. was very similar to the patented product of the company, so it sued Shen Zhi Company to the court.

2065438+February 2008, Guangdong Higher People's Court ruled that Shen Zhi Company compensated DJI Company 1 10,000 yuan, which was the legal maximum compensation for such cases at that time.

A "top case" compensation judgment says "no" to those who maliciously infringe intellectual property rights.

"This judgment has aroused strong repercussions in our entire industry and played a very important role in promoting the healthy development of the entire drone industry." Wei Wu, president of Guangdong UAV Industry Association, said.

Linkage and joint debugging-

Let "great protection" be implemented.

"Chen Gong participated in research and development in our company before and signed a confidentiality agreement. Now leaking our technology is an infringement of trade secrets ... "

2065438+In February, 2006, in the trial court of Nanshan District People's Court in Shenzhen, a fierce court debate "opened fire" between DJI Company and Daotong Technology Co., Ltd.

DJI Company claims that Chen Mou, an engineer hired by Daotong Company, once worked in DJI Company, deeply participated in the development of Phantom 3 of DJI UAV, and provided Daotong Company with the commercial secrets of UAV development.

Daotong Company, also located in Nanshan District, is a high-tech enterprise mainly engaged in the production and sales of R&D and automotive electronic products. Daotong Intelligent Aviation Technology Co., Ltd. is its wholly-owned subsidiary, engaged in the production of R&D and UAV electronic components.

Daotong Intelligent believes that DJI's public release of news is an act of defaming business reputation, so it also sued DJI to the court, demanding to stop infringing on business reputation and reputation rights.

A new product triggered two lawsuits.

"The judgments of the two cases are not difficult, but after the judgment, the two companies have not solved it, and there will be lawsuits in the future." Huang Juanmin believes.

Therefore, Huang Juanmin communicated with the two companies successively, suggesting that enterprises should pay more attention to their future development, shelve disputes and get out of complaints as soon as possible. Thanks to the efforts of the judge, both sides showed their willingness to mediate, but they still held different opinions on the protection of trade secrets.

Therefore, Huang Juanmin found Nanshan Intellectual Property Protection Center to coordinate experts and scholars who protect trade secrets to participate in mediation.

Huang Juanmin and trade secret protection experts made legal analysis on former employees' employment in enterprises respectively. Through the joint efforts of the court and the intellectual property protection center, the two disputes were mediated and dropped, and the two sides shook hands and made peace.

Under the impetus of Nanshan District Court, Nanshan District established the first "6+4+N" one-stop comprehensive service platform for intellectual property rights in China, including 6 protection agencies, 4 trade associations and N intellectual property service agencies. Since then, the whole chain service of intellectual property rights cultivation in advance, operation in the process and protection afterwards has achieved real linkage.

"This platform has built a joint guarantee of justice, administration, industry associations, arbitration and mediation, and has successfully mediated disputes 1352." Liu Jing, director of Nanshan Intellectual Property Protection Center, said.

Equal protection—

Make the business environment more optimized

In 20 19, DJI Company discovered that there was also a company with the same name in Jiangmen City, more than 50 kilometers away from/kloc-0, and used the "DJI" trademark for product promotion on several e-commerce platforms. DJI Company applied for registration of "DJI" trademark as early as 20 12, and was recognized as a well-known trademark by China National Intellectual Property Administration in August of 20 18.

Before the trial, Zhang Haijiang, the presiding judge of this case and then the president of the Third People's Court of Jiangmen Intermediate People's Court, first called the two parties to mediate.

In the face of the judge's patient interpretation of the law, Huang expressed his willingness to transfer the registered trademark for free on the spot, and the company also made it clear that he would not pursue other compensation.

"In the face of local enterprises, Jiangmen Intermediate People's Court insists on equal protection. This is the real business environment ruled by law." Yang Xiaofei, agent ad litem and legal representative of DJI Company, said.

postscript

Let innovators innovate with peace of mind.

From a small four-person workshop to a unicorn enterprise with the largest market share in the global UAV industry, the "take-off" of DJI UAV benefits from the company's continuous investment in technology research and development, and it is also the epitome of the vigorous development of private high-tech industries in the strategy of strengthening the province by technological innovation, in which judicial service guarantee has played an important role.
