1. It is difficult for the patent applicant to pay the fee, and the corresponding certification materials can be provided;
2. The patent applicant submits a request for reduction to the patent administration department of the State Council;
3. The patent administration department in the State Council has made a decision to grant relief.

Article 97
When the applicant goes through the registration formalities, he shall pay the patent registration fee, the printing fee of the announcement and the annual fee of the year when the patent right is granted;
Failure to pay or pay in full at the expiration of the period shall be deemed as failure to go through the registration formalities.

Article 100
Where it is difficult for the applicant or patentee to pay the fees specified in these Rules, it may request the patent administration department of the State Council to reduce or postpone the payment in accordance with the provisions. Measures for reducing or postponing payment shall be formulated by the finance department of the State Council in conjunction with the price management department of the State Council and the patent administration department of the State Council.
