The sixth answer skill of invention patent: no manual support

If the examiner points out in the notice of examination opinions that the claim does not meet the requirement of "based on specification" stipulated in the fourth paragraph of Article 26 of the Patent Law, that is, the claim is not supported by specification, there are two ways to modify the application documents at this time.

(1) If the generalization of the claim is not appropriate when determining the above problems, we should consider further defining the claim to adapt it to the implementation or examples disclosed in the specification. If you think that the technicians in this field can reasonably infer the generality of the claim from the contents recorded in the specification, you can state your own opinions and provide corresponding evidence, which shows that the technicians in this field can reasonably summarize the corresponding technical scheme according to the contents recorded in the specification, so as to strive for better protection scope.

(2) If it is determined that the above problems are caused by the inconsistency between the language in the claim and the language in the specification, or the lack of written description corresponding to the technical scheme in the specification, the above defects can be overcome by modifying the specification.
