Measures for the Administration of Bidding for Construction Projects in Zhuhai Special Economic Zone

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Zhuhai Special Economic Zone in order to regulate the bidding activities of construction projects. Article 2 These Measures shall apply to the bidding activities of construction projects within the administrative area of this Municipality.

The term "construction projects" as mentioned in these Measures includes all kinds of housing construction and municipal public works, traffic engineering, water conservancy engineering, power engineering, landscaping engineering and related ancillary facilities, supporting lines, pipelines, installation engineering and decoration engineering.

The term "bidding for construction projects" as mentioned in these Measures refers to the bidding for survey, design, cost consultation, engineering consultation, supervision, construction and equipment and materials related to construction projects.

The term "equipment and materials related to construction projects" as mentioned in these Measures refers to the equipment and materials that are used to realize the basic functions of construction projects and are inseparable from construction projects. Article 3 The development and reform department (hereinafter referred to as the development and reform department) is responsible for guiding and coordinating the bidding activities of construction projects.

The municipal administrative department of construction (hereinafter referred to as the municipal administrative department of construction) is the regulatory department for bidding activities of construction projects in this Municipality, responsible for the supervision of bidding activities of construction projects in this Municipality and the management of bidding agencies, formulate relevant systems for bidding activities of construction projects in this Municipality, and investigate and deal with illegal acts in bidding activities of construction projects in this Municipality according to law.

Municipal audit institutions shall conduct audit supervision on matters related to bidding according to law.

Municipal transportation, water conservancy, electric power, gardens and other administrative departments. It shall assist the municipal competent department of construction to supervise the bidding activities of construction projects in related industries.

City public * * * resource trading center (hereinafter referred to as the city trading center) is responsible for the construction and management of the city's construction project bidding information platform, trading platform and bid evaluation expert database, providing places and services required for construction project bidding activities, and assisting relevant departments to supervise construction project bidding activities. Article 4 Construction projects that should be subject to tender in accordance with these Measures shall enter the public resource trading platform established in this Municipality according to law (hereinafter referred to as the trading platform) for tender.

Where the state and province have other provisions on the application for trading platforms, such provisions shall prevail. Article 5 The tendering and bidding activities of construction projects shall follow the principles of openness, fairness, impartiality and good faith.

No unit or individual may illegally interfere in bidding activities in any way. Article 6 In addition to the contents that should be kept confidential according to law, information such as construction project bidding announcement, bidding question and answer, bid evaluation report, calibration report, bid winning result, etc. shall be publicly released on the municipal trading platform. Chapter II Bidding Article 7 In any of the following circumstances, a construction project using state-owned or collective funds and other financial funds shall be subject to bidding:

(1) A construction project with an estimated or budgeted price of more than two million yuan for a single contract;

(2) Procurement of construction equipment and materials with an estimated or budgeted price of more than one million yuan for a single contract;

(three) the construction project survey, design, supervision, cost consultation and engineering consulting services with the estimated price or budget price of a single contract of more than 500,000 yuan.

Whether other construction projects and services related to construction projects are subject to tender shall be decided by the construction unit according to law.

If the equipment and materials related to construction projects and non-construction projects that fail to meet the tender quota standards should be purchased in accordance with the relevant provisions of government procurement or property rights transactions, the construction unit shall purchase them according to law. Eighth construction projects that should be subject to tender, all use state-owned, collective funds and other financial funds, or state-owned, collective funds and other financial funds occupy a controlling or leading position, shall be subject to tender, and other construction projects may be subject to tender.

Where there are other provisions of the state and province on the way of bidding, the relevant provisions shall prevail. Ninth construction projects in accordance with one of the following circumstances, you can not tender:

(a) involving national security, state secrets, the relevant departments in accordance with the relevant provisions that is not suitable for bidding;

(2) It is determined by the relevant administrative department that the main technologies need to adopt irreplaceable patents or proprietary technologies;

(three) the construction project resumed after the suspension or extension, and the contractor did not change and perform the project management responsibilities during the suspension or extension;

(four) the construction unit and its holding or dominant subordinate units can build, produce or provide by themselves according to law, except for projects that use financial funds;

(5) Investors of franchise projects selected through bidding can build, produce or provide them by themselves according to law;

(six) it is determined by the competent department of the project that it is necessary to purchase goods or services from the original winning bidder, otherwise it will affect the requirements of construction or functional support;

(seven) the addition of secondary projects or main storey-adding projects that are inseparable from the main project, and the original winning bidder still has the contracting ability;

(eight) not according to the prescribed procedures for two bids;

(nine) other circumstances stipulated by laws, regulations and rules.

If the project using fiscal funds under the circumstances listed in the preceding paragraph is not subject to tender, it shall be reported to the development and reform department for approval. Involving specific identification matters, the development and reform department may solicit opinions from relevant industry authorities, and relevant departments shall provide opinions.

Where the relevant laws and regulations have other provisions on the examination and approval procedures, those provisions shall prevail.
