(a) the project unit has the qualification of legal person;
(two) transportation equipment has been clearly defined, and the funds needed for transportation have been implemented;
(three) meet other conditions required for bidding and transportation. Article 8 A tenderer shall enjoy the following rights:
(1) Organizing bidding;
(two) require bidders to provide information about transportation qualification;
(3) Determine the winning bidder according to the candidates recommended by the bid evaluation team. Article 9 A tenderer shall perform the following obligations:
(a) shall not infringe upon the legitimate rights and interests of bidders;
(2) Sign and perform contracts with the winning bidder. Section 2 Bidders Article 10 Bidders refer to transportation enterprises that participate in bidding according to the requirements of the bidding documents. Article 11 A bidder must meet the following conditions:
(a) manpower, material resources and financial resources that are compatible with the requirements of the tender documents;
(2) Transport qualification and performance corresponding to the bidding documents;
(3) Other conditions stipulated by laws and regulations. Article 12 A bidder shall enjoy the following rights:
(a) Equal access to tender information;
(two) require the tenderer to answer questions about the tender documents;
(3) attending the bid opening meeting;
(four) to accuse and report illegal acts in the process of bidding. Article 13 A bidder shall perform the following obligations:
(a) to ensure the authenticity of the bid documents provided;
(two) according to the requirements of the tenderer to answer questions about the tender documents;
(3) Providing bid bond or other forms of guarantee;
(four) after winning the bid, sign and perform the contract with the tenderer, and may not transfer or subcontract the contract without the consent of the tenderer. Chapter III Tendering and Bidding Procedures Section 1 Tendering Article 14 A tender announcement shall be published in China Electric Power Newspaper or in other forms for public bidding of equipment transportation business required for major projects.
Invitations for bidding or negotiation shall be issued. Fifteenth invitation to tender or negotiation, must meet one of the following conditions:
(1) There are only two or three transportation enterprises to choose from;
(two) the equipment is complex or has special requirements;
(3) Compared with the value of the project subject to tender, the cost of public bidding is not worth it;
(four) involving patent protection or restricted by the natural environment;
(5) Unforeseen and unpredictable emergencies caused by the fault of the tenderer;
(six) did not cause effective competition or did not make a substantive response to the tender documents, resulting in all bids invalid, approved by the Ministry of electric power industry;
(seven) other circumstances stipulated by national laws and regulations and the Ministry of electric power industry. Article 16 A tender announcement or invitation to bid shall at least include the following contents:
(a) the name and address of the bidder;
(two) the nature and quantity of the tender transportation equipment;
(three) the location and time requirements for bidding transportation equipment;
(four) the way, place and time to obtain the tender documents;
(five) the fees charged for obtaining the tender documents. Article 17 A tenderer shall pre-qualify bidders and have the right to require them to provide supporting documents to ensure that only qualified bidders participate in bidding. Eighteenth prequalification should mainly examine whether the bidder meets the following conditions:
(1) Having the qualification certificate of power bulk transport enterprise issued by the Ministry of Electric Power Industry and having passed the annual examination;
(2) Having the ability to successfully perform the contract, including the technical ability, equipment carrying capacity, service quality, quality assurance, financial status and transportation performance of the enterprise;
(3) It is not in a state of being ordered to suspend business, having its property taken over, frozen or bankrupt;
(4) There are no crimes or illegal acts related to defrauding contracts in the last two years (including leaders or key personnel);
(5) There have been no major transportation accidents in the last year. Article 19 A tenderer shall prepare the tender documents according to the requirements of the transportation equipment to be tendered, and provide relevant information to enable bidders to prepare the tender for transportation and services.
The tender documents shall at least include the following contents:
(1) Instructions to Bidders;
(two) the name, nature and quantity of the equipment for the bidding transportation project;
(3) Technical specifications and implementation standards;
(four) the requirements of the tender price and its calculation method;
(5) Criteria and methods for bid evaluation;
(six) the place and time of delivery, arrival, transportation or service of the equipment;
(seven) the relevant qualifications and credit documents provided by the bidder;
(8) Requirements for preparation of bid documents;
(nine) the way, place and deadline for providing the tender documents;
(ten) the date of bid opening, evaluation and selection;
(eleven) the main contract terms.
