What will stop the priority examination of patent reexamination and invalidation cases?

In the process of patent reexamination and patent invalidation cases, there are also many cases that need to extend the examination period. If the review requester delays the reply, it will lead to the extension of the review period; Before the request for priority examination of a patent invalidation case is approved, the parties concerned may supplement the evidence and reasons and amend the patent claim. After the priority examination is approved, the above circumstances will extend the examination period; The procedure of patent reexamination or patent invalidation is suspended, and the trial of a case depends on the conclusion of other cases, which cannot be guaranteed to be closed within the prescribed time limit; When encountering difficult cases, in order to ensure the trial quality and safeguard the rights and interests of the parties, it also takes a long trial time. Therefore, Article 13 of the new measures stipulates that under any of the following circumstances, the Patent Reexamination Board of the State Intellectual Property Office may stop the priority review procedure of this case and handle it according to ordinary procedures:

1. The reexamination requester postponed the reply;

2. After the priority review request is approved, the claimant for invalidation shall supplement the evidence and reasons;

3. After the priority examination request is approved, the patentee modifies the claim by other means other than deletion;

4. The patent reexamination or patent invalidation procedure is suspended;

5. The trial of a case depends on the review conclusions of other cases;

6 difficult cases, and approved by the director of the Patent Reexamination Board.
