Novelty-refers to the fact that no identical invention-creation was published in domestic and foreign publications, publicly used in China or otherwise known to the public before the filing date, and no identical invention-creation was applied to the Patent Office by others and recorded in the patent application documents published after the filing date; Creativity-means that the invention-creation has substantial characteristics and progress compared with the existing technology before the application date; Practicality means that the invention can be manufactured or used and can produce positive effects. 2. The invention-creation of the design for which a patent is applied shall be the same as the design published in domestic and foreign publications or publicly used in China before the date of application.
