Article 3 The scope of government procurement includes the purchase of public consumer goods and government investment products. All public consumer goods and government investment products that reach the specified amount and need to be purchased individually or in batches must be subject to government procurement.
Public consumer goods mainly refer to daily office supplies and labor services for party and government agencies, public institutions, and social groups, including low-value consumables, public office supplies, office equipment, vehicle purchases, Car repair, conference reception and other goods or services.
Government investment products mainly refer to materials, equipment, technology and services for government financial investment construction projects and government loan construction projects included in the fixed asset investment plan. Article 4 Government procurement follows the principles of openness, equality, and merit selection, and is conducted under the supervision of the public, supervisory and auditing agencies, and notary departments. Intermediaries should be entrusted to supervise the implementation of major contracts. Intermediaries participating in supervision work must have corresponding qualifications. Article 5: Establish a government procurement leading group (hereinafter referred to as the leading group). The main responsibilities of the leading group are: to study and formulate government procurement policies and systems, review and approve government procurement plans, and organize and coordinate the relationships between all aspects of the government procurement process.
The leading group consists of the Government Administrative Procurement Office and the Government Construction Procurement Office (hereinafter referred to as the two offices), which are temporarily located in the relevant departments of the Autonomous Region Finance Department and Planning Commission, and are responsible for the procurement of consumer goods and government investment products. government procurement work. The main responsibilities of the two offices are: implement government procurement policies, study and propose annual government procurement plans, organize and guide the development of government procurement activities, and supervise and inspect the implementation of government procurement.
The Government Administrative Procurement Office and the Government Construction Procurement Office have separate procurement centers. The Procurement Center is the executive agency for government procurement. Before the institutional reform, it was temporarily located in the Autonomous Region Finance Department and Planning Commission. Its main responsibilities were determined by the two offices. Article 6 Government procurement shall be conducted through open bidding, selective bidding, competitive negotiation, inquiry, single source procurement or other methods. The specific implementation rules will be formulated separately by the two offices and will be issued after being reviewed and approved by the autonomous region government procurement leading group.
(1) For projects that meet or exceed the specified amount and require single or batch procurement, public bidding will be implemented.
(2) The procurement content is complex, highly technical, and specialized goods, projects or services that can only be provided by a few suppliers; the value of the purchased goods is low, and the cost of organizing and reviewing the bid documents is different from the goods to be purchased, If the value of the project or service is disproportionate, selective bidding and procurement will be implemented.
(3) After the bidding, there are no suppliers to bid or there are no qualified bids, and the normal bidding procedures cannot be carried out; it takes a long time or high cost to prepare the bidding documents; the supplier qualification review process is too complicated, or the For individual or batch procurement projects with special technical requirements, competitive negotiation procurement will be implemented.
(4) Inquiry is implemented for spot commodities that are above the specified amount, purchased individually or in batches, manufactured in accordance with general specifications, with little price elasticity, and with no obvious quality difference between the goods supplied by the supplier. price purchase.
(5) It belongs to patents, works of art, exclusive manufacturing or supply, and there is no other suitable substitute; it belongs to the subsequent maintenance, supply of spare parts, replacement or expansion and upgrading of the original purchased goods, and it is the same as the original purchased subject. Compatibility or unified specification needs; research, development and first-time manufacturing and supply of items; implementation of single-source procurement for single or batch procurement projects to achieve specific policy goals.
Article 7 Government procurement shall be carried out in accordance with the following basic procedures:
(1) Units that need to provide public consumer goods and government investment products shall submit a departmental procurement plan to the competent department in accordance with the "Government Procurement Catalog". After approval, it will be submitted to the Autonomous Region Finance Department and Planning Commission for review.
(2) The Autonomous Region Finance Department and Planning Commission shall prepare annual government procurement plans based on the administrative budget and budgetary investment plan arrangements at the same level, submit them to the Government Procurement Leading Group for approval, and issue them to the two offices respectively. Organization and implementation.
(3) The state-owned assets management department and relevant units shall conduct property rights registration and financial processing based on the acceptance settlement letter and valid bills provided by the supplier. Article 8 Government procurement funds shall be subject to unified expenditure, unified settlement, and management methods that combine centralization and decentralization. According to the source of procurement funds and the different types of goods, projects or services, the methods of unified settlement by the autonomous region finance and autonomous region plans, unified settlement by the procurement center, and self-settlement by the unit and supplier are respectively adopted. Article 9 If party and government agencies, public institutions, social groups and their subordinate units that comply with policy procurement requirements violate the relevant provisions of these Measures to purchase on their own, the financial department shall not handle financial procedures; if the case is serious, the disciplinary inspection and supervision department shall impose party and political penalties. . If the two offices, procurement centers and suppliers violate the relevant provisions of these Measures, the relevant departments will handle them in accordance with relevant policies and laws.
