article 58 of the civil procedure law, the parties and legal representatives may entrust one or two persons as agents ad litem.
The following persons may be entrusted as agents ad litem:
(1) lawyers and grassroots legal service workers;
(2) close relatives or staff members of the parties concerned;
(3) citizens recommended by the community, unit and relevant social organizations where the parties are located.
The selection of the client and the submission of entrustment procedures to the court can be carried out with reference to the following provisions in the Interpretation of the Supreme People's Court on the Application of the Civil Procedure Law of the People's Republic of China:
Article 85 According to the provisions of Item 2, Paragraph 2, Article 58 of the Civil Procedure Law, there are husband and wife, lineal blood relatives, collateral blood relatives within three generations, close in-laws and other relatives who have the relationship of support and maintenance, and the parties may be close relatives.
article 86 according to article 58, paragraph 2, item 2 of the civil procedure law, an employee who has a legitimate labor and personnel relationship with the party concerned may act as an agent ad litem in the name of the party concerned.
Article 87 According to Item 3, Paragraph 2, Article 58 of the Civil Procedure Law, if a social organization recommends a citizen as an agent ad litem, it shall meet the following conditions:
(1) The social organization is a non-profit legal person organization registered or exempted from registration according to law;
(2) The principal belongs to the social group, or the domicile of one party is located in the activity area of the social group;
(3) agency affairs belong to the business scope specified in the articles of association of the social group;
(4) The recommended citizen is the person in charge of the social group or a staff member who has legal labor and personnel relations with the social group.
a patent agent is recommended by the all-China patent agents association to act as an agent ad litem in patent dispute cases.
Article 88 In addition to submitting the power of attorney in accordance with Article 59 of the Civil Procedure Law, an agent ad litem shall also submit relevant materials to the people's court in accordance with the following provisions:
(1) A lawyer shall submit a lawyer's practice certificate and certification materials of a law firm;
(2) Grassroots legal service workers shall submit the practicing certificate of legal service workers, the letter of introduction issued by grassroots legal service and the certification materials that one party is located in the jurisdiction;
(3) the close relatives of the parties concerned shall submit their identity documents and proof materials of close relatives with the client;
(4) the staff members of the parties concerned shall submit their identity documents and proof materials of their legal labor and personnel relations with the parties concerned;
(5) citizens recommended by the community or unit where the parties are located shall submit their identity documents, recommendation materials and proof that the parties belong to the community or unit;
(6) Citizens recommended by relevant social organizations shall submit their identity documents and certification materials that meet the conditions stipulated in Article 87 of this Interpretation.
