Examination questions, may I ask whether the custody contract can be inherited when the custodian dies?

custody contracts cannot be inherited.

This is because

1. Article 2 of China's Contract Law stipulates that the contract referred to in this Law is an agreement between natural persons, legal persons and other organizations with equal subjects to establish, change and terminate civil rights and obligations. Agreements on identity relations such as marriage, adoption and guardianship shall be governed by other laws.

Custody contract belongs to the scope of contract law adjustment, and it does not belong to the agreement on identity relationship.

2. Article 3 of China's Inheritance Law stipulates:

Legacy is the personal legal property left by a citizen when he dies, including:

(1) the income of a citizen;

(2) Houses, savings and daily necessities of citizens;

(3) citizens' trees, livestock and poultry;

(4) citizens' cultural relics, books and materials;

(5) The law allows citizens to own the means of production;

(6) citizens' property rights in copyright and patent rights;

(7) Other lawful property of citizens.

the contract is not included in the scope of inheritance.

therefore, when the custodian dies, the custody contract cannot be inherited.
