According to the provisions of the Administrative Procedure Law, the cases of first instance under the jurisdiction of the Intermediate People's Court mainly include:
1. Cases of confirming invention patent right and cases handled by customs
A case in which the invention patent right is confirmed refers to a case in which a citizen, a legal person or any other organization refuses to accept the decision of the Patent Reexamination Board of the State Patent Office to reject the request for reexamination; Or refuses to accept the decision of the Patent Reexamination Board to declare the granted invention patent right invalid at the request of others after the patent right is granted; Or other obligees refuse to accept the decision to maintain the originally granted invention patent right and bring an administrative lawsuit to the people's court. Cases involving invention patents and cases handled by the customs are professional and technical, and the quality of handling cases can be better guaranteed by the intermediate people's court in the first instance.
2. Cases of bringing lawsuits against specific administrative acts of various departments in the State Council or people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
The Intermediate People's Court conducts the first instance of such administrative cases, mainly considering that the cases handled by these administrative organs generally have great influence, the issues involved are also more important, and they are more policy-oriented and professional. As the first instance, the Intermediate People's Court can concentrate the backbone, eliminate interference and improve the quality of handling cases.
3. Major and complicated cases in the region.
Among the people's complaint cases, all cases involving a wide range, involving a large number of people and units, cases with unclear legal boundaries and big disputes, cases with great external interference and resistance, cases with strong social repercussions and strong reactions from the masses, and major foreign-related cases are major and complicated cases. The Intermediate People's Court is the people's court of first instance.
In addition, the Intermediate People's Court, as the court of first instance, has jurisdiction over administrative cases appealed by grassroots people's courts.

Article 17 The basic people's courts shall have jurisdiction over civil cases of first instance, except as otherwise provided by this Law.
Article 18 The Intermediate People's Court shall have jurisdiction over the following civil cases of first instance:
(1) Major foreign-related cases;
(two) cases that have a significant impact in the region;
(3) Cases determined by the Supreme People's Court to be under the jurisdiction of the Intermediate People's Court.
Article 19 Jurisdiction of the High Court
The Higher People's Court shall have jurisdiction over civil cases of first instance with great influence in its jurisdiction.
Twentieth the Supreme People's Court has jurisdiction over the following civil cases of first instance:
(1) Cases with great influence in the whole country;
(2) Cases that should be tried by the court.
Article 21 A civil action brought against a citizen shall be under the jurisdiction of the people's court where the defendant has his domicile. If the defendant's domicile is inconsistent with his habitual residence, it shall be under the jurisdiction of the people's court of habitual residence. A civil lawsuit brought against a legal person or other organization shall be under the jurisdiction of the people's court where the defendant is domiciled. If the domicile and habitual residence of several defendants in the same lawsuit are under the jurisdiction of two or more people's courts, they shall be under the jurisdiction of each people's court.
