Professor Yang: Invisible acupuncture products were invented in 2005, and the concept of invisible acupuncture was formally put forward at the end of 2005. In the first half of 2005, after years of repeated experiments, we made a small piece of nano-material which can stimulate the hot numbness of human acupuncture points. After many people tried it voluntarily, the effect was very good. Later, it was used by doctors in several hospitals, and the clinical effect was particularly remarkable. What name are we considering approving? At that time, considering the issue of FDA approval, it was thought that it might be easier to approve in the field of rehabilitation, so it was called rehabilitation chip. Therefore, as a medical device, the rehabilitation chip was registered and approved in September 2005. With the approval and products, there is still no concept to promote, and it is not clear what to sell. On June 5438+065438+ 10, 2005, I met Mr ren yandong of state administration of traditional chinese medicine science and technology center. He is the doctor of Professor Shi Xuemin, an academician of Chinese Acupuncture Society. After trying out the product, he said that the rehabilitation chip has an exciting effect on human acupuncture points and is an acupuncture effect. Of course, this kind of acupuncture does not need needles, silver needles, moxibustion, electricity or magnetism. It is passive, non-invasive and painless, and can be reused for thousands of times. It's amazing. The two of us thought hard for a while and came up with an inspiration: invisible acupuncture. So there was the concept of invisible acupuncture. Later, I wrote a paper on the invisible acupuncture rehabilitation chip, which was read at the Third International Conference on Traditional Chinese Medicine. The concept of invisible acupuncture has had an impact in the field of traditional Chinese medicine. In 2006, Dr. Xu and Dr. Ren and I compiled the monograph Super Therapy-Invisible Acupuncture and Acupoint Therapy, which was published by China Science and Technology Press and was very popular. It was printed several times. This monograph is prefaced by Professor Shi Xuemin, President of the World Federation of Acupuncture Societies, Director of the Institute of Acupuncture and Moxibustion of Chinese Academy of Traditional Chinese Medicine, Academician of China Academy of Engineering and Vice President of Chinese Acupuncture and Moxibustion Society. The concept of invisible acupuncture has gained a certain popularity in China and even the world.
The concept of invisible acupuncture did not exist before (it can be traced back to 2005 five thousand years ago). At present, those who engage in fake and inferior products in the market say that they invented invisible acupuncture or write the concept of invisible acupuncture, which is false. Later, from the perspective of materials science, I divided acupuncture into three generations:
The first generation is called acupuncture with natural materials, such as bian stone, bone needle and bamboo needle.
The second generation is called metal needle, such as copper needle, iron needle, gold needle, silver needle and stainless steel needle, which are currently used in the mainstream;
The third generation is called invisible acupuncture, which is a passive nano-new material acupuncture without needle and acupuncture stimulation.
At a meeting in Beijing, Professor Shi of Beijing University of Chinese Medicine thought that the statement that invisible acupuncture is the third generation of acupuncture should be changed to the fourth generation of acupuncture, because electroacupuncture is the third generation of acupuncture and invisible acupuncture is the fourth generation of acupuncture. I think it makes sense. Electroacupuncture is also a revolution in acupuncture tools. Acupuncture tools from natural materials to metal materials is a tool revolution, and metal acupuncture is superior to stone needles, bone needles, bamboo needles and wood needles; From metal acupuncture to electromagnetic acupuncture, it is also a tool revolution. It applies energy and magnetic sources including laser energy to acupuncture. The activity of acupuncture is better than that of common needle, silver needle and steel needle. From electromagnetic acupuncture to invisible acupuncture is another tool revolution, which changes acupuncture tools into needleless and passive, and relies on new material technology to solve the pain problem of acupuncture and ensure the curative effect of acupuncture. Therefore, I readily accept Professor Shi's objection to me. Invisible acupuncture should be located in the fourth generation of acupuncture.
Reporter: You have obtained the invention patent and utility model patent of invisible acupuncture. What is the scope of patent protection? How to protect the intellectual property of invisible acupuncture?
Professor Yang: Last year, China Patent Office approved my patent application for "Invisible Acupuncture Therapeutic Apparatus" and issued a patent certificate for utility model. Recently, another invention patent of invisible acupuncture, namely the invention patent of invisible acupuncture rehabilitation chip, was also approved by China Patent Office and awarded to China. The utility model patent of contact needle protects the structure of contact needle, and the invention patent of contact needle protects the composition, manufacturing process and products of contact needle. Unauthorized use of the ingredients, materials and techniques in my patent to produce various products that stimulate the rehabilitation, treatment and health care of meridians and acupoints involves infringement of my invisible acupuncture patent. According to China's new patent law, anyone who imitates another person's patent, in addition to bearing civil liability according to law, shall confiscate all the illegal income and may be fined less than 4 times the illegal income; There is no illegal income, can be fined 200 thousand yuan; If a crime is constituted, criminal responsibility shall be investigated according to law. Therefore, those who engage in fake and shoddy invisible acupuncture shall be punished as patent infringement. Generally, it is investigated, and the fine may be more than 654.38+0 million, which is not worth the candle. Now some people in the market don't have a real patent, so it is foolish to write a fake patent number and say that they have applied for a patent, trying to deceive consumers. On the one hand, the original invention has already come first, and it was fake when it was applied. On the other hand, according to Article 59 of the Patent Law, it is illegal to pass off non-patented products as patented products and pass off non-patented methods as patented methods, and a fine of less than 200,000 yuan can be imposed. Moreover, there is also a crime of manufacturing fake and inferior products in China, and those who make and sell fake products can be investigated for criminal responsibility. At present, the government of China has made the protection of intellectual property rights a national strategy, and vigorously cracked down on counterfeiting. Fake and shoddy products may be investigated at any time. Apart from being condemned morally, it is really not worth the loss economically.
Reporter: Professor Yang, would you please talk about the difference in clinical efficacy between true and false invisible acupuncture?
Professor Yang: We invented the invisible acupuncture rehabilitation chip, and it was confirmed that its clinical efficacy was reliable after a lot of clinical empirical research. Since 2005, we have been doing clinical work in dozens of hospitals, including hospitals in Hunan, Shandong, Guangdong, Chongqing, Beijing and other provinces and cities. Among them, there are 3-A hospitals 10, and 5 of them are national pharmacological clinical experimental bases. They did clinical research according to the requirements of GLP, which proved that the clinical effect of the invisible acupuncture rehabilitation chip we invented was reliable. In particular, state administration of traditional chinese medicine passed the expert appraisal on August 2007 10, and the rehabilitation chip was included in the promotion project of scientific and technological achievements in state administration of traditional chinese medicine. In 2008, the Department of Science and Technology of state administration of traditional chinese medicine selected the rehabilitation chip into the project of "50 standardized demonstration studies on clinical diagnosis and treatment technologies with Chinese medicine characteristics". In 2009, state administration of traditional chinese medicine's "Standardized Study on Invisible Acupuncture Treatment of Osteoarthritis" was officially launched in Guang 'anmen Hospital of Chinese Academy of Traditional Chinese Medicine, and the project has ended. After the conclusion, the Ministry of Health and state administration of traditional chinese medicine will promote it as an appropriate technology in hospitals all over the country. This proves that the clinical effect of real invisible acupuncture has been confirmed by clinical hospitals and even state organs with high professional standards. However, fake and shoddy invisible acupuncture has never been studied in hospitals or passed the national research, so there is no evidence to test the clinical effect. Some have copied some materials, but most of them are wrong and can't stand verification. Therefore, the clinical effect of fake invisible acupuncture can not be guaranteed at all.
Reporter: What is the difference between Professor Yang's true and false invisible acupuncture in terms of production technology and quality?
Professor Yang: The real invisible acupuncture is produced in strict accordance with the technological requirements of the invention. False invisible acupuncture only imitates the appearance and surface effect, and its quality is essentially different, which is mainly reflected in three aspects: First, the material composition is different. The real invisible acupuncture chip is made of a variety of polar materials according to strict formula, so as to ensure that the chip can generate photon flow, ion flow and electron flow under the agitation of human body's own energy, which has the effect of acupuncture point agitation. In order to save cost, the fake invisible acupuncture tablets are not equipped with polar materials according to the formula at all, and most of them have no polar materials at all. They are just an ordinary tile, which can be burned from a ceramic factory for a few cents, and it is useless. The second is the difference in material technology. The real invisible acupuncture chip uses nano-material technology to process polar materials, so the cost is relatively high. The cost of nano-powder materials is more than 10 times higher than that of micro-powder materials. Nanoscale polar materials can pass more than 1000 mesh, while micron polar materials can only pass 200 mesh. The powder material used for fake invisible acupuncture tablets is just ordinary crushing, which can't pass 80 meshes, and has no specific performance of invisible acupuncture at all. Thirdly, due to the difference of manufacturing technology, the real invisible acupuncture chip should be made into ultra-microporous structure, and the firing temperature should be controlled at about 800℃, so as to ensure the effective performance of the chip. However, low temperature sintering at 800℃, ultra-microporous structure, technical difficulties, can not achieve fake and shoddy processing. Generally, the sintering temperature of ceramics is above 1200℃, otherwise there is no strength. If it exceeds 900℃, polar materials may fail. Therefore, fake invisible acupuncture tablets often just take some ordinary pottery tablets and paint some irritating pigments, pretending to be invisible acupuncture, without any technical and quality guarantee.
Reporter: What you said is very important, but it is too professional. Please tell ordinary consumers how to distinguish between true and false invisible acupuncture at the time of purchase.
Professor Yang: First of all, let's see what company produces it. At present, the inventor of stealth acupuncture only authorizes two companies to produce a series of stealth acupuncture products in China. These two companies are Shennong (Hunan) Biotechnology Co., Ltd. and Shennong (Jilin) Biotechnology Co., Ltd., except these two companies, all kinds of products produced by other companies in the name of invisible acupuncture are fake and shoddy products.
Secondly, check the authenticity of the information they provide. Including the authenticity of the product description materials provided, the authenticity of clinical materials, the authenticity of patent materials, etc. The basis for distinguishing authenticity has been mentioned earlier. Generally, the information of fake and shoddy products is fabricated, and there are many problems with horse mouths. With a little attention, you can tell whether it is fake or not. The professional standards of these companies are generally poor. I have seen a well-known company selling fake invisible acupuncture, saying that it is not necessary to stick the chip according to the acupoint prescription. What is that, invisible acupuncture?
Third, check the product quality. This is more difficult. Professional quality inspection needs to detect the components of polar materials, stirring performance, clinical treatment effect and service life times of the chip. Someone asked me if there is a simple way to tell the good from the bad by hand and experience. If you simply distinguish: first look at the hardness and strength of the chip. The fake invisible acupuncture chip is generally an ordinary ceramic piece, which is hard and firm and has a bright surface. This polar material is definitely ineffective after high temperature sintering. Second, after the chip is broken, it depends on whether there is a uniform ultra-microporous structure in the middle of the chip. The core of fake invisible acupuncture chip is generally hardened in the middle, and there is no uniform ultra-microporous structure. Thirdly, the service life of fake invisible acupuncture tablets has been repeatedly tested. Fake invisible acupuncture tablets, with some irritating substances on the surface, feel hot when attached to the skin. Generally, there is only surface stimulation, but there is no deep stimulation at acupoints. Repeated use for dozens of times will not work. The real invisible acupuncture has deep agitation at the acupoints, and it still has strong stimulation at the acupoints after thousands of uses.
Reporter: What are the fake and shoddy products of invisible acupuncture on the market at present? How to rectify in the future?
Professor Yang: I have noticed that there are two kinds of fake and inferior invisible acupuncture products in the market at present: one is to set up a company to sell fake and invisible acupuncture products and entrust production. Although they also say they produce, in fact they neither know nor will produce. Some of these companies have sold authentic invisible acupuncture products in the past, and some have done some supporting services for authentic companies in the past. They know the market, the cost of entrusted processing is very low, and they want to make more money by counterfeiting. One is to help fake companies produce fake invisible acupuncture tablets. Some of them engage in ordinary small ceramics, and some have kilns, which specialize in firing foundry. Some of them have been engaged in heating materials and also participated in fake invisible acupuncture. But these are very small enterprises, and older enterprises will not do such stupid things.
Although these companies engage in fake invisible acupuncture, which hurts consumers, it also plays a certain role in the spread of invisible acupuncture. Therefore, to rectify the fake and shoddy invisible acupuncture market, I advocate both suppression and suppression. On the one hand, we should take advantage of the state's protection of intellectual property rights and severely punish the sale of counterfeit invisible acupuncture. Now that you have a patent, you can hit them once and never turn over. On the other hand, I advocate that we can unite and make use of the opportunity of invisible acupuncture to get rich. In fact, it is not easy for those companies that engage in fake invisible acupuncture. They are all small companies, and it is difficult to make money. Doing anti-counterfeiting to reduce costs is to reduce market risks for yourself. In fact, it is not worth the loss to fake them. One company is a husband and wife company. After the business failed in 2007, I borrowed 800,000 cash from my friend and made the invisible acupuncture products of Shennong (Jilin) Company. After one year, I earned more than 2 million yuan, paid off the loan and cost, and earned hundreds of thousands. In 2008, the husband and wife used their funds for other purposes because they had their own things. But later, they mistakenly thought that their friends bought a batch of fake invisible acupuncture and asked for a refund after selling it to consumers. They couldn't get a refund from the fake manufacturer, so they spent hundreds of thousands. Since then, I have never recovered, and I have to do everything possible to digest the backlog of fake invisible acupuncture, and my reputation is getting worse and worse. Those factories that help to process fake invisible acupuncture are even worse, and the processing fee is pitifully low. Once patent infringement is investigated, counterfeiting is easier to be caught than selling fakes. No matter whether there is illegal income or not, the minimum penalty is 200 thousand. It is impossible for them to earn 200,000 yuan in counterfeit money within 10 years, which is more than the loss. Therefore, if genuine manufacturers are combined, the invisible acupuncture market will be huge, everyone will be legal, and there will be more money to earn, so as to avoid the worries of illegal counterfeiting and selling, and form a win-win situation, which may be an ideal choice for rectifying and managing the market of counterfeit invisible acupuncture products.
