In order to meet the relevant needs of the parties in economic and legal activities, China National Intellectual Property Administration has further optimized the composition of patent certificates and copies of patent certificates on the basis of providing real-time, convenient and transparent information inquiry channels to patentees and the public through the Internet platform, without attaching patent brochures. The relevant matters are hereby announced as follows:
1. authorizes patents whose announcement date is from March 2, 20 18 (inclusive) to April 24, 20 18 (inclusive). The patent certificate issued by China National Intellectual Property Administration includes the first page of the certificate and the title page of the patent booklet.
Two. For patents whose authorization announcement date is after April 24, 20 18 (inclusive), China National Intellectual Property Administration will issue new patent certificates and copies of patent certificates after the authorization announcement date. The new version of the patent certificate and the copy of the patent certificate will cancel the patent booklet and add the authorization announcement number and the address information of the patentee.
Three, the old version, the new version of the patent certificate and the copy of the patent certificate have the same legal effect, and the issued old version of the patent certificate and the copy of the patent certificate shall not be replaced by the new version of the patent certificate and the copy of the patent certificate, except as otherwise provided.
Four, since the date of authorization announcement, the patentee and the public can query and obtain the corresponding patent fascicles from the China National Intellectual Property Administration municipal government website China patent announcement system.
According to the above provisions, the original patent certificate has no difference in legal effect except the name.
