Patents for different purposes

According to the patent law, only one patent is granted for the same invention-creation, so when examining the invention patent, the Patent Office will ask you to give up the previously authorized utility model patent, otherwise the invention patent will not be authorized. Once the prior utility model patent is abandoned, the invention patent can be granted, but it is impossible to grant two patents at the same time.

With regard to the claims, the same invention-creation referred to here means that the necessary technical features in the claims are the same. Otherwise, it wouldn't be the same invention mentioned here.

Regarding submission, submit the utility model first, and then submit the invention. Note that before the publication of the utility model patent, you must submit an application for invention, and then spend three years actually hearing the invention patent. This will have the longest actual protection period.
