At present, domestic companies or individuals apply for foreign patents mainly through the PCT channel, that is, after applying for a patent in China, the applicant applies for a PCT patent to the China National Intellectual Property Administration International Bureau within 12 months from the filing date. After the examination and approval by the International Bureau, the applicant may file a patent application with any PCT convention country.
The situation is different in different countries. Generally, it takes about three years in the United States and more than five years in Europe, and these are relatively smooth situations. If the other party issues multiple review opinions, the time will be extended 1~2 years.
