The standard review period is generally not more than a few years.

The review period after the implementation of the standard is generally not more than 5 years. The review of standards shall be organized by the competent department or standardization technical committee to collect and sort out the problems that need to be reviewed in the implementation of standards. The review can be conducted by meeting or letter, and the review results should be made in written form, such as review overview, handling opinions, review conclusions and basis. Confirm whether the current standard is valid, revised or abolished.

What is the review process of the review procedure?

1, formal review. After receiving the reexamination request submitted by the claimant, the Patent Reexamination Board shall first conduct a formal examination;

2. Pre-trial. If the applicant for reexamination submits the revised text during reexamination, the preliminary examination shall first examine whether the revision of the application documents is limited to eliminating the defects pointed out in the rejection decision. In accordance with the provisions, the revised text as the basis for pre-trial; Do not meet the requirements, insist on rejecting the decision, and give a detailed explanation of the opinions that do not meet the requirements;

3. collegiate review. In the process of collegiate bench review, the collegiate bench group conducts a comprehensive study on the review request, application documents and the pre-trial opinions of the original review department;

4. Review the decision. After the above work, the collegial panel made a review decision by voting on the basis of finding out the facts and in accordance with the principle that the minority is subordinate to the majority.

After the implementation of the standards, the standard-setting department shall conduct a timely review according to the development of science and technology and the needs of economic construction. The standard review period is generally not more than five years.

Article 19

When formulating standards, we should give full play to the role of industry associations, scientific and technological research institutions and academic groups.

Departments that formulate national standards, industrial standards and local standards shall organize experts from users, production units, trade associations, scientific and technological research institutions, academic organizations and relevant departments to form a standardization technical committee, which is responsible for drafting standards and participating in the technical review of draft standards. If the standardization technical committee is not established, the standardization technical centralized unit may be responsible for drafting standards and participating in the technical review of the draft standards.

The formulation of enterprise standards should fully listen to the opinions of users and scientific and technological research institutions.
