When entering the national phase of China, the applicant shall make a written statement at the time of application, and submit a copy of the first patent application document within three months, and the priority shall remain valid. The applicant did not make a statement at the time of application, or failed to submit a copy of the first patent application document within three months, and the applicant has made a request in the international stage. Second, the applicant's written statement of priority in the international phase is misspelled or the application number of the earlier application is not specified, and he may make a request for correction when going through the formalities for entering the China phase, or specify the application number of the earlier application, but he shall pay the prescribed fee for correction of priority request. Failure to pay or pay the correction fee for the priority request within the prescribed time limit shall be deemed as failure to make a priority request; 3. According to the provisions of the patent cooperation treaty, the applicant has submitted a copy of the priority application document in the international stage of the international application. When an international application enters the international phase in China, it is not necessary to submit a separate copy of the priority application document. However, if it is not submitted in the international phase, it shall be provided when the international application enters the national phase of China. If it is not provided within the specified time, it shall be deemed that the priority claim has not been submitted. Four, the applicant's priority claim in the international phase is regarded as not put forward, and announced by the International Bureau, the applicant has a legitimate reason, you can request the the State Council patent administration department to restore its priority when going through the formalities for entering the national phase in China; 5. Where the applicant requests the patent administration department of the State Council to process and examine the international application in advance before the expiration of 20 months from the priority date, he shall make a request in accordance with the requirements of the patent cooperation treaty when the international application enters the national phase of China. Where the international application is not forwarded to the patent administration department in the State Council through the International Bureau, the applicant shall submit a copy of the application documents confirmed by the International Bureau to the patent administration department in the State Council; 6. Where an international application claims priority, the applicant shall pay the priority claim fee when going through the formalities for entering the national phase of China. If it is not paid or not paid in full, the patent administration department of the State Council shall notify the applicant to pay within the specified time limit; If the priority is not paid or fully paid at the expiration of the time limit, it shall be deemed that the priority has not been claimed.
