1, the difference between inventor, applicant and patentee is as follows:
(1) differentiated by definition. Patent holder: the owner and holder of the patent right. Inventor, according to the provisions of the patent law, in the invention patent and utility model patent, the person who contributes to the specific substantive features of the invention creation is called an inventor;
(2) Different from rights. The patentee's rights include patent personal rights and patent property rights. The inventor may request the Patent Office not to publish his name.
2. Legal basis: Article 6 of People's Republic of China (PRC) Patent Law.
An invention-creation made by carrying out the tasks of the unit or mainly using the material and technical conditions of the unit is a service invention-creation. The right to apply for a patent for a service invention-creation belongs to the unit. After the application is approved, the unit becomes the patentee. Units may dispose of the patent application right and patent right of their service inventions and creations according to law, and promote the implementation and application of related inventions and creations.
The right to apply for a patent for a non-service invention-creation belongs to the inventor or designer; After the application is approved, the inventor or designer shall be the patentee.
Where an invention-creation completed by making use of the material and technical conditions of the entity has a contract with the inventor or designer to stipulate the right to apply for a patent and the ownership of the patent, such agreement shall prevail.
2. What obligations does the patentee need to undertake?
The obligations that the patentee needs to undertake include:
1. After obtaining the patent right, the patentee shall pay the annual fee on time;
2. Pay the annual patent fee on time every year to ensure the validity of the patent right. If the annual patent fee is not paid within the time limit, the patent right will be lost, and the invention will no longer be protected by the patent law, and anyone can use it at will.
