Rules for Patent Agent Qualification Examination (2008)

Section 1 Registration for Examination Article 1 A person who registers for the National Patent Agent Qualification Examination shall choose one of the test sites suitable for him to take the examination, and register at the intellectual property offices of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the intellectual property offices of test sites) within a specified time by means of on-site registration, letter registration or online registration. Article 2 An applicant shall submit the following materials and pay relevant fees:

(a) the application form and photos;

(two) a copy of valid identity documents;

(three) a copy of the academic certificate;

(4) Original work certificate.

In case of on-site registration, the applicant shall present the valid identity certificate and the original academic certificate at the time of registration for inspection; If you register by letter or online, you should go to the intellectual property office of the selected test center for inspection with valid identity documents and original academic certificates within the specified time.

Applicants can download the application form from the website of China National Intellectual Property Administration Municipal Government. Article 3 The intellectual property offices of each test center shall promptly report the original registration form of the applicant and relevant information and materials to the Office of the Patent Agents Examination Committee (hereinafter referred to as the Office of the Examination Committee). Article 4 The admission ticket shall be numbered uniformly by the office of the review committee.

The intellectual property offices of each test center shall issue admission tickets to applicants who meet the relevant regulations, and inform the applicants of the matters that candidates are required to know in accordance with this rule. Section 2 Examination Room Setting and Examination Room Staffing Article 5 The intellectual property offices of each examination center shall set up examination rooms according to the principle of centralization and convenience.

Setting up an examination room shall meet the following requirements:

(a) the number of candidates in each examination room is 30, and if the remainder is less than 30, a single examination room will be set up;

(two) each candidate has a table, and there should be a gap of more than one table between candidates;

(3) Paste the candidate's name and admission ticket number in the upper right corner of each form;

(four) the environment around the examination room should be safe and quiet, and the ladder classroom should not be used as the examination room. Article 6 Each test center shall have a chief examiner, who shall be the director or deputy director of the intellectual property office of the test center and be responsible for the invigilation of the test center. Each examination room has a male and a female invigilator, who is responsible for the specific invigilation of the examination room.

The examiner shall hold a briefing on the invigilator's responsibilities attended by all invigilators and patrol examiners at the latest one day before the exam. Article 7 The intellectual property offices of each test center shall, according to needs, arrange security and medical personnel to help maintain the examination order and provide medical assistance services. Article 8 The intellectual property office of the test center shall set up an examination office near the test center as a place to handle relevant affairs. Section 3 Delivery and Custody of Examination Papers Article 9 Examination papers and answer sheets shall be delivered to the examination center by the office of the Examination Committee, and the specific matters and confidentiality obligations shall be agreed by both parties. Article 10 The intellectual property offices of each test center shall be equipped with special secret rooms and safes for storing test papers and answer sheets, and equipped with seals and special vehicles for transporting test papers.

Security room should be waterproof, fireproof, anti-theft and other security measures, and the implementation of 24-hour monitoring. The safe for storing test papers and answer sheets shall be sealed.

The secret room for storing test papers is far away from the examination room. If it is necessary to temporarily store test papers or answer sheets in the examination room, it shall be equipped with a safe in the examination room, and relevant security work shall be strengthened. Article 11 The intellectual property offices of each test center shall designate two or more test paper custodians to be responsible for the custody of test papers.

The keys to the secret room and the safe are kept by different test paper keepers. Article 12 Access to examination papers and answer sheets from the safe shall be operated by two or more examination paper keepers, and patrol examination personnel shall be present.

The examination paper and answer sheet shall be made in detail by the examination paper keeper, and signed on the Examination Paper and Answer Sheet Access Record Sheet made by the office of the jury, and signed by the inspection personnel for confirmation. Thirteenth test papers and answer sheets before unsealing, and valid answer sheets after sealing, no one may unseal them without authorization for any reason. Fourteenth papers in the process of transportation and storage leaks or other accidents, should immediately take effective measures to prevent proliferation, and promptly report to the office of the evaluation committee. Section 4 Rules of Examination Room Article 15 Candidates shall enter the examination room with the admission ticket and valid identity documents 20 minutes before the examination of each subject, take their seats according to the admission ticket number, and place the admission ticket and valid identity documents in the upper right corner of the examination table for invigilators to check. Sixteenth candidates who are more than 30 minutes late are not allowed to enter the examination room. Candidates can only hand in their papers 30 minutes after the exam begins. Seventeenth candidates are not allowed to bring the following items into the examination room:

(a) any books, periodicals, notes and paper with words;

(2) Any electronic product with communication, storage, recording and playback functions.

Candidates who carry the items mentioned in the preceding paragraph shall be kept by invigilators before the examinations of various subjects begin. Eighteenth candidates should use the pen correctly, fill in the name on the answer sheet and fill in the admission ticket number as required within the specified time, and paste the bar code if necessary; Fill in the blanks and write clearly when answering questions.

Because the candidates did not fill in their names, admission ticket numbers or stick bar codes as required, their identities could not be confirmed and the test papers were invalid; If the test paper cannot be reviewed or the test results are affected due to the damage to the answer sheet, incomplete filling or illegible handwriting, the responsibility shall be borne by the candidate himself.
