In order to further standardize the procurement business of the local government procurement center in Changzhou, Changzhou Tendering Network has formulated the relevant policy guidelines of the Measures for the Administration of Government Procurement without Bidding, which mainly include (1) general provisions (2) general provisions (3) competitive negotiation (4) single-source procurement (5) inquiry (6) legal liability (7) supplementary provisions, etc. The contents of single-source procurement are as follows:
Article 38 Where the goods and services that fall within the scope of the first paragraph of Article 31 of the Government Procurement Law and reach the amount of public bidding are to be purchased by single source, the purchaser and the procurement agency shall publicize them in the media designated by the financial department at or above the provincial level before reporting them to the financial department for examination and approval in accordance with the provisions of Article 4 of these Measures, and report the publicity to the financial department together. The publicity period shall not be less than 5 working days, and the publicity contents include:
(a) the name and content of the purchaser and the procurement project;
(2) Description of the goods or services to be purchased;
(3) Reasons for adopting the single-source procurement method and relevant explanations;
(four) the name and address of the proposed exclusive supplier;
(five) the specific opinions of the professionals on the uniqueness of the relevant suppliers due to patents, proprietary technology and other reasons, as well as the names, work units and professional titles of the professionals;
(6) Time limit for publicity;
(seven) the contact address, contact person and telephone number of the purchaser, the procurement agency and the financial department.
Thirty-ninth suppliers, units and individuals who have objections to the publicity of single-source procurement can give a written feedback to the purchaser and the procurement agency within the publicity period, and send a copy to the relevant financial departments.
Fortieth buyers and procurement agencies shall organize supplementary argumentation within 5 working days after the expiration of the publicity period after receiving the objection to adopting the single-source procurement method. If the objection is established through argumentation, other procurement methods shall be adopted according to law; If the objection is not established after argumentation, the objection, argumentation and publicity shall be reported to the relevant financial department.
The purchaser and the procurement agency shall inform the supplier, unit or individual who raises the objection of the conclusion of the supplementary argument.
Forty-first single-source procurement, the purchaser and the procurement agency shall organize professionals with relevant experience to negotiate a reasonable transaction price with suppliers to ensure the quality of the procurement project.
Forty-second single-source procurement personnel shall make consultation records, mainly including:
(a) publicity in accordance with the provisions of article thirty-eighth, publicity;
(2) The date and place of negotiation and the list of procurement personnel;
(three) the cost of the subject matter of the procurement provided by the supplier, the contract price of similar projects, and related patents and know-how;
(four) the main terms of the contract and the price agreement.
The negotiation record shall be signed and approved by all procurement personnel. If the purchaser disagrees with the record, he shall sign a different opinion and explain the reasons. If the buyer refuses to sign the record and fails to explain the different opinions and reasons in writing, it shall be deemed as consent.
Article 43 Under any of the following circumstances, the purchaser or procurement agency shall terminate the procurement activities, issue a project termination announcement and explain the reasons, and resume the procurement activities:
(a) Due to changes in circumstances, it no longer meets the applicable conditions of the prescribed single-source procurement method;
(two) there are illegal acts that affect the procurement justice;
(3) The quotation exceeds the purchase budget.
