What are the qualifications of applicants for Philippine trademarks?

Trademark owners with Philippine nationality can apply for trademark registration with the Philippine Bureau of Special Trade and Technology Transfer as long as they use their trademarks in Philippine commerce at least two months before the date of applying for trademark registration.

Foreign legal persons and natural persons must have a fixed business place and domicile in the Philippines, and must be citizens of their country of origin. In addition, the applicant must use his trademark in the Philippine business at least 2 months before the date of applying for trademark registration, and can apply for trademark registration with the Philippine Patent, Trademark and Technology Transfer Bureau. Citizens of Paris Convention member countries can apply for trademark registration with the Philippine Bureau of Special Trade and Technology Transfer according to the trademark application or registration in their country of origin, or submit the use certificate within three years from the application date, without taking the earliest commercial use in the Philippines as the basis.
