A drug was patented, but later generations developed it in their own way. Can we still apply for patents?

If the final result is exactly the same from the production process and formula! Article 9 of the Patent Law: Where two or more applicants apply for a patent for the same invention-creation, the patent right shall be granted to the first applicant.
