High imitation refers to imitation made according to the original shape, material and function of the imitation object. As a noun, high imitation is often used to imitate high-end consumer goods with low technical barriers, such as imitation leather goods, handbags, glasses and other international luxury goods. High imitation not only copies the main or all elements such as the appearance of the genuine product, but also retains the brand identity of the genuine product, so the high imitation product is actually a highly simulated counterfeit product. The appearance and workmanship of high imitation goods are highly imitations of genuine products, especially the appearance is very similar, so ordinary consumers can't tell the difference between true and false without looking carefully.
Violations of the exclusive right to use a registered trademark are as follows:
1. Using the same trademark as its registered trademark on the same commodity without the permission of the trademark registrant;
2. Without the permission of the trademark registrant, using a trademark similar to its registered trademark on the same kind of goods, or using a trademark identical with or similar to its registered trademark on similar goods, is likely to cause confusion;
3. Selling goods that infringe the exclusive right to use a registered trademark;
4. Forging or manufacturing others' registered trademarks without authorization or selling forged or manufactured registered trademarks without authorization;
5, without the consent of the trademark registrant, change its registered trademark and put the goods with the changed trademark on the market again;
6. Deliberately providing convenient conditions for infringing upon the exclusive right to use a trademark of others and helping others to commit acts of infringing upon the exclusive right to use a trademark;
7, causing other damage to the exclusive right to use a registered trademark of others.
To sum up, high imitation goods belong to goods with counterfeit registered trademarks, and if the illegal income from selling high imitation goods is large or there are other serious circumstances, it constitutes a crime.
Legal basis:
Article 2 14 of the Criminal Code of People's Republic of China (PRC).
Whoever knowingly sells goods with counterfeit registered trademarks, and the amount of illegal income is relatively large or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than three years and shall also or only be fined; If the amount of illegal income is huge or there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years and shall also be fined.
Article 2 15
Whoever forges or makes a registered trademark logo of another person without authorization or sells a forged or made registered trademark logo without authorization, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years and shall also, or shall only, be fined; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined.
Article 2 16
Whoever counterfeits another person's patent, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also, or shall only, be fined.
