Foreigners who have their habitual residence or business office in China should enjoy the same treatment as nationals of that country according to the provisions of the Paris Convention, so the procedures for applying for patents are exactly the same as those of units and individuals in China. You can apply for it yourself or entrust a domestic patent agency to handle it. During the examination, the examiner shall require the applicant to provide proof of residence or business place or a valid business place certificate issued by the local industrial and commercial department.
2. To apply for a patent in China, a foreigner, foreign enterprise or other foreign organization without a habitual residence or business office in China shall meet one of the following three conditions: the country where the applicant belongs has signed an agreement with China to grant patent protection to the nationals of the other country; The applicant's country is a member of the Paris Convention for the Protection of Industrial Property; The laws of the country where the applicant belongs have the principle of reciprocity, and foreigners are granted patent protection. Those who meet one of the above three conditions shall entrust a patent agency designated by the State Council to act as an agent in accordance with Article 19 of the Patent Law, and cannot directly submit an application to the Chinese Patent Office.
