If the design meets the following two requirements, you can file an application:
1. Novelty: before the filing date or priority date, there is no identical appearance known to the public in Switzerland design. However, if a third party maliciously discloses the design or the right owner discloses the design 12 months before the filing date or priority date, the novelty of the design will not be affected.
2. Originality: Compared with the known designs in Switzerland, it will give people a different overall impression.
