Recently, the notice of China National Intellectual Property Administration Patent Agent Qualification Examination in 2006 was issued, and a large number of examination materials emerged in the market. Many netizens can't tell whether to buy it or not, and what to think after buying it. Let me give my personal opinion on the whole.
Let's talk about the necessary materials for preparing for the exam first, and explain them in volumes below;
1: Volume I Knowledge of Patent Law, (150 points)
The contents involved include "basic knowledge of patents, substantive conditions for granting patents, requirements for patent application documents, procedures and formalities for applying for patents, reexamination of patent applications, invalidation of patents, implementation of patents, effectiveness and protection of patents, patent documents and patent classification, and international treaties and agreements related to patents (Patent Cooperation Treaty, Budapest Treaty on the Preservation of Microorganisms, Strasbourg Agreement on International Patent Classification, Locarno Agreement on International Classification of Industrial Designs).
At present, all these can be obtained free of charge through electronic files. The core part is a thorough understanding of the patent law and detailed rules, which needs to be reviewed in combination with the review guide and the detailed explanation of the new patent law. So you only need to buy a detailed explanation of the new patent law to prepare the first volume, but some people are not used to reading electronic documents, so you need to buy paper documents of relevant laws, regulations and rules. By the way, according to personal observation, the newly revised exam guide will not be used as the content of this year's exam, because the exam outline has been announced at the end of March, and it is impossible to finalize the newly revised exam guide in a short time. Therefore, in 2006, the version of the agent examination guide will be subject to the current version (see

2. Relevant legal knowledge (100 mark)
"The subjects of this examination involve: General Principles of Civil Law, Contract Law, Civil Procedure Law, Administrative Procedure Law, Administrative Reconsideration Law, Criminal Law, Guarantee Law, Foreign Trade Law, Copyright Law, Trademark Law, Anti-unfair Competition Law, Regulations on the Protection of New Plant Varieties, Regulations on the Protection of Layout Design of Integrated Circuits, Regulations on the Protection of Olympic Symbols, Regulations on Customs Protection of Intellectual Property Rights, Paris Convention on the Protection of Industrial Property Rights, and related knowledge of trade-related intellectual property agreements. ? "
These materials also have ready-made electronic files, but for non-law students, it is obviously laborious and inefficient to read only these materials. In fact, this paper is equivalent to a miniature small judicial examination. Therefore, I suggest that when you prepare this paper, you can learn from the review methods of the teacher exam. Ding Ding also fought on the battlefield of the exam and tried a lot of materials for the exam. Only one of them is completely used by me, and I have read it twice. I think it is also very suitable for preparing the second volume of the agent exam, that is, combining with the key law of Li Jianwei (see: /viewthread.php? Tid = 58 & extra = page% 3d2% 26filter% 3ddigest) Read French. Over and over again, you will have the feeling of finding a way. Combining doing real questions with reviewing, a small test will do.
3. Volume III, Patent Agency Practice (150)
This volume involves writing, OA, disability and other exercises. If the estimate is correct, writing will definitely account for more than 50% of the score. For writing, the most important thing is to practice writing, and it is best to have experienced people to guide you. But it will be more convenient to have a guide book at hand. Therefore, I suggest that you buy one from the "Patent Application Document Writing and Practice Series" (all six volumes) according to your own situation, and most of them will be too late to read it. Regarding OA, invalidity and other practices, this part is a new examination content this year, which is a challenge for candidates without practical experience. I guess if they only look at the existing data and can't get close to practice, it will be difficult to distinguish this part. This can be confirmed from the volume Review and Ineffectiveness in 2004, but it is just like the saying "Examination is the art of giving up". The agent exam also needs to be given up to some extent. Therefore, it is suggested that candidates who have no practical experience should not make too much effort in this part, and the contents of other parts can be made up as long as they concentrate on reviewing. Back to the topic at the beginning, I think everyone should know exactly what books to buy. As for the 2006 National Patent Agent Qualification Examination Guide, it seems that, like the one in 2004, it is only an unoriginal combination of existing laws, regulations, rules, international treaties and judicial interpretations. Friends who like to use computers can not buy them at all.
As for patent documents and information, this book contains a lot of content, and there is no guarantee that you will get high marks after reading it before the exam. There are a lot of targeted materials on the Internet (including China National Intellectual Property Administration Bureau Orders (No.32 to No.34)), but this book is worthy of reference in future practice.
Related remarks:
1: There are many people and exams in China. This is universally acknowledged and has become a habit. I think we should add another one, and the information in each exam is also a dime a dozen. The selection of materials and materials is actually a contest of candidates' ability outside the examination room.
2. On behalf of the majority of candidates, I would like to give some suggestions to the Acting Examination Committee, that is, China National Intellectual Property Administration.
A: At present, most candidates lack good practical training materials. Please publish the 2004 exam questions. Since it will be published every year in the future, why not make a demonstration and publish the examination questions in 2004 first?
B: I'd like to see the electronic document of the syllabus. At the very least, candidates who need an exam outline should not be forced to buy an exam guide of 100 RMB at the same time. Why not publish a special exam outline like other exams? But if this is the case, the sales of the national patent agent qualification examination guide in 2006 will decline.
The above is my humble opinion, please criticize.
