How to lift the pledge of patent right

With the certificate of completion of contract performance and the Notice of Registration of Patent Pledge Contract, the parties concerned shall go through the formalities of registration and cancellation of the pledge contract at the Chinese Patent Office. If the parties fail to cancel the registration within 0/5 days after the expiration of the pledge period, the contract registration will be automatically cancelled. According to the Interim Measures for the Administration of Registration of Patent Pledge Contracts, the situations that need to go through the registration and cancellation procedures of pledge contracts with the Patent Office are as follows: (1) Dissolving the pledge contract in advance; The parties concerned shall, within seven days after the signing of the agreement on canceling the pledge contract, go to the Chinese Patent Office for the registration and cancellation of the pledge contract with the agreement on canceling the pledge contract and the notice of registration of the patent pledge contract. (2) The patent right is invalid, revoked or lost for other reasons; The parties concerned shall, within seven days from the date of receiving the notice, go through the registration and cancellation procedures of the pledge contract at the Chinese Patent Office with the certificate of loss of patent right and the original Notice of Registration of Patent Pledge Contract. (3) The pledge contract is invalid because the main contract is invalid; (4) The pledge period expires. In case of the above four situations, China Patent Office will issue the Notice of Cancellation of Registration of Patent Pledge Contract to the parties after examination. The patent pledge contract shall be invalid from the date of registration and cancellation.
