The full name of the trip agreement is "Trade-Related Aspects of Intellectual Property Rights Agreement."
TRIPS agreement is the abbreviation of AGREEMENT ON TRADE-RELATED ASPECTS OF INTELLECTUAL PROPERTY RIGHTS. This document is the international standard for intellectual property protection.
The purpose of "TRIPS" is to reduce distortions and obstacles in international trade, promote adequate and effective protection of intellectual property rights, and ensure that enforcement measures and procedures for intellectual property rights do not become legal obstacles.
The intellectual property rights involved in the "TRIPS" agreement include the following eight aspects: copyright and related rights, trademarks, geographical indications, industrial designs, patents, integrated circuit layout designs, future Protection of rights to public information and control of anti-competitive conduct in licensing contracts.
At the same time, the agreement has made detailed provisions on the availability, scope and exercise standards, implementation, acquisition and maintenance procedures, dispute prevention and resolution of the above-mentioned intellectual property rights, which exceeds any existing The international convention on intellectual property rights will make intellectual property issues and trade issues inseparable.
Contents of the Agreement:
1. Each member shall make the provisions of this Agreement effective. Members may, but shall not be obliged to, implement in their laws broader protection than required by this Agreement, provided that such protection does not violate the provisions of this Agreement. Each Member shall have the right to develop appropriate methods of implementing the provisions of this Agreement within their own legal systems and practices.
2. For the purpose of this Agreement, the term "intellectual property" refers to all categories of intellectual property mentioned in Sections 1 to 7 of Part II.
3. Each member shall provide the nationals of other members with the treatment provided for in this Agreement. With regard to relevant intellectual property rights, nationals of other members shall be understood to be eligible for protection under the Paris Convention (1967), the Berne Convention (1971), the Rome Convention and the Treaty on Intellectual Property Rights Concerning Integrated Circuits Standard natural or legal person.
