How to judge whether a patent is an appearance patent or an invention patent?

First of all: Article 2 of the Patent Law Inventions and creations mentioned in this Law refer to inventions, utility models and designs.

Invention refers to a new technical scheme proposed for a product, method or its improvement.

Utility model refers to a new practical technical scheme for the shape, structure or combination of products.

Appearance design refers to a new design with aesthetic feeling and suitable for industrial application based on the shape, pattern or combination of products and the combination of colors, shapes and patterns.

It can be distinguished from objects. Invention patents protect products and methods, while appearance patents protect the combination of shapes, patterns or colors, mainly for the appearance of products.

Secondly: distinguish from the patent application number. The first four digits of the patent application number are the year of the patent application. If the fifth digit is 1, it represents an invention patent; If it is 2, it represents a utility model patent; If it is 3, it stands for appearance patent. If a patent number is: 20 15 10 xxxxxxxx. x, it means that this is an invention patent filed on 20 15. If it is 20 1530 xxxxxxxx. x, it means that it is an appearance patent applied for on 20 15.
