Instructions for the use of patent examination and complaint platform
The patent examination quality complaint platform has been running well since it was put into operation on July 22nd, 201/KLOC-0. In order to collect the opinions and suggestions of the public on patent examination more widely, continuously improve the examination quality, improve the examination efficiency and strengthen the examination service, the patent examination quality complaint platform was upgraded to the patent examination complaint platform, and it was officially put into operation.
The public can register users or anonymously log on to the patent examination complaint platform to submit complaints about all aspects of patent examination in China National Intellectual Property Administration. China National Intellectual Property Administration will accept the complaint in time, complete the complaint handling within the specified time, and inform the complainant of the reply. Registered users can log on to the patent examination complaint platform to inquire about the progress of complaint acceptance and handling.
The complaint of patent examination can not replace the reply to the relevant patent application examination opinions, nor can it replace the initiation of relevant legal procedures. Anyone who refuses to accept the decision or specific administrative act made by the China National Intellectual Property Administration Patent Office and the Patent Reexamination Board shall, within the statutory time limit, make a request for reexamination or invalidation, apply for administrative reconsideration or bring a lawsuit to the people's court according to law.
The opinions on handling patent examination complaints only represent the explanation or explanation of complaints, not administrative decisions or examination opinions, and have no legal effect.
