First, the situation facing the development of intellectual property rights in our city

With the development of economic globalization, the international competition with intellectual property as the main means is becoming increasingly fierce, and the role of intellectual property system in improving regional core competitiveness, promoting technological innovation and industrial upgrading, and forming and maintaining the sustainable competitive advantage of enterprises is becoming increasingly obvious. In today's world, independent intellectual property rights and independent innovation ability have become decisive factors in the competition of comprehensive national strength. The State Council decided to formulate and implement the national intellectual property strategy, give full play to the role of the intellectual property system in promoting independent innovation, and improve the international competitiveness of China's economy.

During the Tenth Five-Year Plan period, our city's intellectual property work developed rapidly, becoming a national patent pilot city in 2002, a national intellectual property pilot city at the end of 2004, and one of the first three national intellectual property demonstration cities in April 2005. In 2005, the number of patent applications in the city was 724 1, which was 2.69 times higher than that in 2000. The authorized quantity is 3079 pieces, which is 2.05 times higher than that in 2000; The number of applications and authorizations ranks among the best in sub-provincial cities in China. There are more than 42,000 registered trademarks in the whole city, including 13 well-known trademarks in China, 233 well-known trademarks in the province and 153 well-known trademarks in the city. There are more than 870 copyright registrations for works such as writing and art, and more than 800 copyright registrations for computer software. However, in the face of the current situation and requirements of rapid economic and social development in our city, there are still obvious shortcomings in our intellectual property work: First, the awareness of intellectual property rights in the whole society is weak, and the ability and level of enterprises and institutions to master and use the intellectual property system are low; Second, the independent innovation ability of enterprises and institutions is not strong, the proportion of invention patents and foreign-related patents is low, and the proportion of patent technology transformation is low; Third, the ability of intellectual property protection can not meet the requirements of the development of the situation, the ability of administrative law enforcement and team building need to be further strengthened, and the development of industry self-discipline and rights protection organizations lags behind; Fourth, the functions of intellectual property network information service and social intermediary service are not perfect, which can not meet the needs of the rapid development of intellectual property in our city; Fifth, Chengdu's rich historical and cultural resources and traditional products with local characteristics have not been fully tapped and utilized from the perspective of intellectual property rights.

Second, the guiding ideology and main objectives

Guiding ideology: Take Deng Xiaoping Theory and Theory of Three Represents as the guidance, establish and implement Scientific Outlook on Development, take the opportunity of establishing a national intellectual property demonstration city, strengthen the comprehensive capacity building of intellectual property rights, promote the construction of high-tech Chengdu, enhance the image of Chengdu's opening to the outside world, and promote the coordinated and sustainable development of economy, science and technology and society.

Main objectives: to create a national intellectual property demonstration city, fully integrate intellectual property work into the economic and social development process of our city, greatly improve the comprehensive level of intellectual property creation, management, implementation and protection in the city to 20 10, and build Chengdu into a strong intellectual property city with strong innovation vitality, smooth transformation channels, strong intellectual property protection, leading in the central and western regions and leading in the country.

3. Establish and improve the intellectual property management system of enterprises and institutions. Deepen the pilot demonstration of intellectual property rights in enterprises and institutions, focus on key regions, key industries, key enterprises, key universities and research institutes, establish intellectual property management institutions, implement full-time staff and working funds, improve the internal management system of intellectual property rights, and clarify the property management, benefit distribution and information utilization system of patent rights, trademark rights, copyrights, trade secrets and other related intellectual property rights.

Encourage enterprises to innovate through original innovation, integrated innovation, introduction, digestion, absorption and re-innovation, and strive to achieve key technological innovation and key breakthroughs in intellectual property rights in the fields of electronic information, machinery, medicine and chemical industry, new materials, etc., and form an industrial intellectual property group, which has significantly improved industrial competitiveness.

(3) Implement the "Plan for Improving the Ability to Use Intellectual Property Rights" and vigorously promote the transformation and application of intellectual property rights.

1. Clarify the policy orientation for promoting the transformation and application of intellectual property rights. Relying on the Chengdu United Assets and Equity Exchange, Chengdu West Trademark Service Trading Center and other intermediary service institutions, as well as associations such as invention associations and entrepreneurs associations, we will explore the establishment of a smooth intellectual property trading mechanism and promote the market-oriented transformation of intangible assets such as patents, trademarks and copyrights. Improve the intangible assets evaluation system, and study and explore intellectual property rights transformation mechanisms such as pricing shares, pledge, trust and auction. 3. Strive to promote the comprehensive application of enterprise intellectual property rights. Formulate policies to encourage enterprises and institutions to comprehensively use intellectual property rights and enhance the awareness of intellectual property rights. Deepen the pilot demonstration of intellectual property rights, support the cultivation of 100 pilot demonstration units of intellectual property rights, give play to the demonstration and backbone role of advantageous enterprises, and form a cluster effect of intellectual property export. Encourage enterprises to formulate and implement intellectual property (patent) strategies that combine their own characteristics, increase product technology research and development and intellectual property investment, incorporate intellectual property rights into enterprise product technology development, manufacturing, market expansion and asset management, actively cultivate core intellectual property rights, increase intellectual property reserves, and improve the comprehensive application level of intellectual property rights.

The annual settlement rate of administrative law enforcement cases exceeds 90%.

3. Establish and improve the cooperation mechanism of intellectual property protection departments. Establish the "Chengdu Leading Group Office for Intellectual Property Protection" in due course, strengthen the administrative law enforcement cooperation of patent, trademark, copyright, public security, culture, quality supervision and other administrative departments, closely communicate with courts, procuratorates and Chengdu Customs, and gradually establish a cross-regional and cross-industry cooperation mechanism for intellectual property protection. Focus on trademark rights, copyrights and patents, and take effective measures to curb and crack down on all kinds of infringements. Explore the establishment of an industry intellectual property protection mechanism that combines administrative law enforcement, industry self-discipline and enterprise rights protection. Implement the trademark licensing publicity system in the city.

4. Strengthen the protection of intellectual property rights in key areas. Strengthen service and law enforcement inspection around key areas and important links such as production, scientific research, commodity circulation, technology trade, large-scale exhibitions, creation and dissemination of works, historical and cultural resources, and important city signs. Focusing on leading industries such as electronic information, medicine, machinery and food, we will promote enterprises to formulate and implement intellectual property (patent) strategies, establish a patent-based intellectual property dynamic analysis data system, flexibly use joint research and development, mergers and acquisitions, introduction and other strategies to create and protect independent intellectual property rights, and improve the predictability and early warning of enterprises' scientific research, production and import and export trade.

5. Strengthen the protection of trade secrets. Enterprises should formulate and implement a protection system for trade secrets, especially technical secrets, and take strict protection measures for core technologies in high-tech fields and traditional advantageous industries that are not suitable for public protection by way of patents, so as to prevent the disclosure of trade secrets from causing huge losses.

6. Strengthen intellectual property protection in an open economy. In import and export trade, foreign capital utilization and foreign investment, do a good job in analyzing the domestic and international intellectual property status of related products or technologies, and handle the relationship between export and introduction, introduction and innovation; Strengthen customs protection of intellectual property rights and establish an early warning mechanism for intellectual property rights in foreign trade; Actively respond to foreign-related intellectual property disputes and improve the ability to handle and coordinate foreign-related intellectual property disputes.
