How to write a claim
The claim is a patent application document, indicating the scope of patent protection. The scope of patent protection is based on the recognized claims. Judging whether others infringe is also based on the content of the claim. Therefore, claims are the core of patent application documents. The patent claim shall specify: (1) the technical features of the invention or utility model, and clearly and concisely specify the scope of the requested protection. Several claims shall be numbered in Arabic numerals, and the technical terms used shall be consistent with the specification, and there shall be no illustrations. (2) The independent claim shall reflect the main technical contents of the invention or utility model as a whole and record the necessary technical features that constitute the invention or utility model. Unless the nature of the invention or utility model needs to be expressed in other ways, the independent claim shall first write a preface to explain the technical field to which the invention or utility model belongs and the technical features closely related to it in the existing technology; Then write the characteristic part to explain the technical characteristics of the invention or utility model. An invention or utility model should have only one independent claim, which is written before the subordinate claim of the same invention or utility model. (3) Dependent claims that refer to one or several claims can only refer to the previous claim. Unless the nature of the invention or utility model needs to be expressed in other ways, the subordinate claim shall be cited first, and the number of the cited claim shall be indicated. If possible, the number shall be written in the first sentence. Then write the characteristic part, clarify the technical characteristics, and further clarify the technical characteristics of the cited part.
