Article 9 Rights and obligations of the entrusting party

Article 10 Owners' Committee

As the executing agency, the entrusting party's owners' committee has the following rights and obligations:

2] Supervise and assist the service provider to perform the property service contract;

3) Organize the handover and acceptance of the property;

(4) urge all owners to abide by the owners' convention, the rules of procedure of the owners' congress and the rules and regulations of property management;

5] Supervise and urge the owners who violate the property service contract and fail to pay the property service fee within the time limit;

Article 11 Rights and obligations of service providers

1] Provide property management services in this property area according to the authorization of the entrusting party, relevant laws and regulations and the agreement in this contract;

2] Have the right to request the entrusting party, the owners' committee, the owners and the users of the property to cooperate with the service provider's management service behavior;

3) Collect property service fees from owners and property users;

4] Owners and property users have the right to take measures to discourage and stop acts that violate the owners' convention and property management system according to the seriousness;

5] Select a franchise company to undertake the special management business of the property, but the overall management of the property shall not be entrusted to a third party;

6] Report the implementation of property management services to the entrusting party every year;

Article 13 Termination of the Contract

If the entrusting party decides not to entrust the entrusted party at the expiration of this contract, it shall notify the entrusted party in writing three months in advance; If the trustee decides not to accept the entrustment, it shall notify the entrusting party in writing three months in advance.

After the expiration of this contract, if the client fails to inform the service provider of the opinion of renewing or dismissing the service provider, and fails to hire a new property management enterprise, and the service provider continues to manage it, this contract shall be deemed as automatic renewal.

After the termination of this contract, before the new property management enterprise takes over the property project, the service provider shall continue to provide temporary (generally no more than three months) property management services to the entrusting party according to the requirements of the entrusting party, and the entrusting party owner (or payer) shall also continue to pay the corresponding property service fees.

Article 14 Liability for breach of contract

If the Consignee fails to provide the agreed services due to the breach of contract by the Consignor, the Consignee has the right to ask the Consignor to solve the problem within a certain period of time. In case of overdue settlement and serious breach of contract, the trustee has the right to terminate the contract. If economic losses are caused to the Consignee, the Consignor shall pay economic compensation to the Consignee.

If the trustee fails to provide services as agreed, the entrusting party has the right to ask the trustee to make corrections within a time limit. If the service provider fails to make rectification within the time limit and seriously breaches the contract, the entrusting party has the right to terminate the contract with the consent of the owners with more than two-thirds voting rights at the owners' meeting. If economic losses are caused to the entrusting party, the entrusted party shall give the entrusting party economic compensation.

If the Consignee violates the contract and raises the charging standard without authorization, the Client has the right to ask the Consignee to leave; If economic losses are caused to the entrusting party, the entrusted party shall give the entrusting party economic compensation.

If the owner fails to pay the property service fee within the time limit, the service provider may charge a penalty of 1/10000 of the payable fee on a daily basis from the date of overdue.
