How to write an amendment to apply for a patent

Patent modification is very particular, and it cannot be modified without modification, nor can it be modified beyond the scope.

The examiner will specify the contents that need to be corrected in the notice of correction, and modify the application documents one by one according to the examiner's opinions.

1. This form should be handwritten, printed or printed in black Chinese in duplicate.

2. The contents in column ① of this form shall be consistent with those in the patent request. Where the application has gone through the formalities for changing the description item, it shall be filled in according to the contents approved by the Patent Office.

3. The applicant in column ① of this form shall be the first applicant to sign.

Four, the box in the second column of this form is for the person to choose, and should be marked in the box.

5. The applicant for a patent for invention may, within 3 months from the date of requesting substantive examination and receiving the notice from the Patent Office that the application for a patent for invention has entered the substantive examination procedure, take the initiative to propose amendments to the application for a patent for invention.

An applicant for a patent for utility model or design may, within 2 months from the date of application, put forward amendments to the application for a patent for utility model or design.

Six, an application for a patent for invention or utility model specification or the amendment of the claims, except for individual text modification or addition or deletion, shall be submitted in accordance with the prescribed format. Where an application for a patent for invention involves nucleotide or amino acid sequences, a paper replacement page and a CD or floppy disk consistent with the contents of the replacement page shall be submitted on its own initiative or at the request of the examiner. Where a picture or photograph of an application for a patent for design is modified, a replacement page shall be submitted in accordance with the provisions.

7. In the fifth column of this form, if a patent agency is entrusted, the patent agency shall affix its official seal. If a patent agency is not entrusted, if the applicant is an individual, it shall be signed or sealed by the applicant himself; If the applicant is a unit, the official seal of the unit shall be affixed; If there are more than one applicant, it shall be signed or sealed by the applicant who signed first; if the representative is not the applicant who signed first, it shall be signed or sealed by the representative specified in the request.
