Rules for the management of lawyers' practice.

Article 1 These Rules are formulated in accordance with the Lawyers Law of People's Republic of China (PRC) (hereinafter referred to as the Lawyers Law), the Articles of Association of the Lawyers Association and the Measures for the Administration of Lawyers' Practice Certificates of the Ministry of Justice in order to standardize the lawyers' practice activities and ensure the quality and order of practice.

Article 2 These Rules shall apply to persons who have obtained China lawyer qualification or legal professional qualification certificate and practice in law firms for the purpose of applying for lawyer practice (hereinafter referred to as interns).

Article 3 An intern shall apply to a law firm for an internship, and may participate in the internship only after the director of the law firm agrees and the municipal lawyers' association approves the internship.

Without internship, the internship period is less than one year, or the internship appraisal is unqualified, you may not apply for a lawyer's practice certificate.

Article 4 An intern shall sign an internship agreement with the law firm that accepts the internship, stipulating the following matters: (1) the name of the applicant;

(two) the name and address of the law firm that accepted the internship;

(3) The name, practice certificate number and practice period of the guidance lawyer;

(four) the rights and obligations of interns and law firms, as well as the starting and ending time of the internship.

(5) the agreement on the fees of trainee lawyers.

Article 5 An internship applicant shall submit the following materials to the local lawyers association: (1) an internship application form;

(2) The internship agreement signed by the intern and the law firm accepting the internship;

(3) the intern's lawyer qualification certificate or legal professional qualification certificate (copy); The applicant's academic certificate (copy);

(four) a copy of the applicant's identity card, and the temporary residence permit issued by the public security organ by the non-internship household registration personnel (copy);

(5) the resignation certificate issued by the applicant's unit, or the file keeping certificate issued by the talent exchange center, and other original materials that prove that I can work as a lawyer full-time;

(6) A certificate issued by the public security organ of the applicant's unit or domicile that he has not been subjected to criminal punishment;

(7) One-inch recent bareheaded photo.

Article 6 When applying for internship, a person who intends to engage in the lawyer profession on a part-time basis shall, in addition to the materials mentioned in items (1), (2), (3), (4), (6) and (7) above, also submit the certification documents issued by the law school (department) and legal research unit where he belongs.
