What is the overview of Malaysian design patents?

The main laws and regulations on patent protection in Malaysia include the Patent Law (1983) and the Patent Rules (1986). The Patent Law was revised several times in 1993,2,22,23 and 26. According to the Patent Law and the Patent Rules, an applicant can apply for a patent directly in Malaysia. Once registered, the patent is valid throughout Malaysia.

on January 1, 1989, Malaysia acceded to the Paris convention for the protection of industrial property (hereinafter referred to as the Paris convention).

on August 16th, 26, the Malaysian government submitted its accession to the Patent Cooperation Treaty to the World Intellectual Property Organization. Since then, Malaysia has formally joined the Patent Cooperation Treaty.

Therefore, foreign enterprises and individuals can apply for a patent in Malaysia through the Paris Convention and PCT (Patent Cooperation Treaty) or enter the national phase in Malaysia within 3 months of PCT application.
