Manufacturers in the smart phone industry chain in Chinese mainland are still unaffected by this war. Will they be involved in this war? What can they learn from the patent war cases in recent years? China Intellectual Property News reporter interviewed Liu Fang, a senior partner of Beijing Tongli Juncheng Intellectual Property Agency Co., Ltd., who has long been concerned about the domestic communication field.

Apple has more and more invention patents in China.

According to the results of patent search conducted by the reporter, in Apple's patent application in China, there are five names in the column of applicants: Apple, Apple Computer Company, Apple Computer Co., Ltd., Apple Computer Company and Apple Computer (Limited) Company. These five applicants filed 65,438+0,536 patent applications.

Liu Fang told China Intellectual Property News that compared with other multinational companies, Apple's patent application in China mainly focused on product appearance and internal software principles. It is reported that Apple has not set up a research and development center in China at present, and these domestic patents are basically the same family of Apple's American patents. Liu Fang said that they "entered China as scheduled".

The reporter found through patent search that the view that "Apple's China patents are almost all design patents" may be out of date. Among the 1366 patent applications with Apple as the applicant, there are 265 patent applications for design, accounting for only 19.4%, and 944 patent applications for invention, accounting for 69. 1%.

However, due to the long examination time of invention patents and the short authorization period of design patents, 26 1 of these 265 applications for design patents have been authorized. Of the 944 invention patent applications, 229 have been authorized. Among the 642 valid patents for which "Apple Company" is the applicant, the valid patents for invention, utility model and design each account for one third, and the growth potential of invention patents is extremely considerable. It can be predicted that if there are no accidents in the next two years, the number of invention patents granted by Apple in China will increase substantially, and then Apple will have the basic ammunition to initiate patent litigation in China.

Who is likely to be involved in this war?

Will Apple's patent war spread to China? Liu Fang said that her personal opinion is that Apple may not directly "go to war" in Chinese mainland in the short term, but the marginal effect of global patent disputes will spread and ferment in China.

Liu Fang said that at present, all the participants in the global smartphone war have their own relatively independent market share in China. At the same time, these multinational companies are not familiar with the intellectual property litigation system in China, and may not rashly attack. Moreover, "the amount of infringement penalty in China will not reach the level of $6,543.8+$05 million. In reality, litigation in China will not have a great impact on other countries. " Therefore, Liu Fang believes that the "China battlefield" of "smartphone wars" will not be opened in the short term. "However, the aftershocks caused by the patent disputes between Apple and other companies will spread in China, and will also awaken and stimulate people's awareness of intellectual property rights to a great extent."

Once the patent war spreads to China, among all domestic enterprises that cross Apple's product line, who may be affected and in what form? Liu Fang predicted several possibilities.

"The first is the parts manufacturing industry. China is the manufacturing place of products of major manufacturers all over the world. The huge market is bound to cause great controversy. Disputes may occur between enterprises in China, between enterprises in Taiwan Province Province, between China and China, between enterprises in Taiwan Province Province of China, and between foreign countries and China.
